Project Description:

The Department has made a tentative determination to issue a permit modification to the Part 360 permit for the Sheesleys Sewer Service Solid Waste Management Facility to authorize the use of 60 precast septic tanks at the site for storage during winter months. The application includes a variance request from the 1 year interior inspection and cleaning requirements due to the fact that the tanks are new and small in size. The Department proposes to authorize the variance for 2.5 years and reconsider it during the renewal application process which will commence July 31, 2014. Tanks will be inspected from the exterior and will be kept track of through recordkeeping. Any observed exterior leakage will require immediate repair or removal of tank from service. The file is available for review and comment at the NYSDEC Regional Office.

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Jul 26, 2012.

Project Description:

Edward J. Machuga proposes a one acre expansion of a 26.1 acre surface sand and gravel mine to 27.1 acres, on a 65.9 acre property in the Town of Bradford. The additional acre is a 75 foot wide strip to be added to the east side of the currently permitted Life of Mine area. Operation of the mine will continue unchanged. Final reclamation will convert the entire mine site to open vegetated land and will include the replacement of stockpiled topsoil and re-seeding to establish a vegetative cover.
The mine site is located on the Edward Machuga property on the south side of NYS Route 226 approximately 1600 feet northeast of the intersection of County Route 17.
The complete application is available for review at the Region 8 NYSDEC office at address listed below, and a copy of the complete application has been sent to the Town of Bradford.
