The Department has prepared a draft modified SPDES Permit (NY0202631) and made a tentative determination to approve the permit renewal for Outfall 007 from the Village of Williamsville sanitary sewer collection system. The outfall is to Ellicott Creek with a Class and Standard of B. Outfall 007 is a Type 1 Sanitary Sewer Overflow and is prohibited from discharging except in emergency situations when there is no feasible alternative, and the permittee complies with the reporting requirements in the permit. The applicant also proposes to modify the permit to delete six Outfalls (001, 002, 003, 004, 005 and 008) from the permit as they have been sealed and can no longer discharge from the Village's sanitary sewer collection system. The village has been able to eliminate these discharges to Ellicott Creek by implementing a concerted infiltration and inflow removal and pipe replacement program. The Department is seeking comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of the activity for which a permit is sought.

State Environmental Quality Review (SEQR) Determination:
Project is not subject to SEQR because it is a Type II action.
SEQR Lead Agency: None Designated
State Historic Preservation Act (SHPA) Determination:
The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.
This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Comments on this project must be submitted in writing to the Contact Person no later than Aug 03, 2012.
