Project Description:

The NYS Department of Environmental Conservation (DEC) proposes to extend the expiration date of its permit to treat up to 12 acres of mono-specific stands of Phragmites australis within NYS designated Freshwater Wetland SG-3 (Tivoli North Bay), with the herbicide Rodeo (active ingredient glyphosate). DEC also proposes to modify this permit to allow glyphosate treatment anywhere in Tivoli North Bay (an approximately 364 acre area), where Phragmites stands may develop. This modification would allow DEC to rapidly respond to new Phragmites infestations, rather than delay treatment until the stands become well-established. It is anticipated, however, that treatments will continue to primarily focus on eight mapped stands that have been treated annually under previously issued DEC permits, commencing in 2006. All treatments will occur within 2.5 hours of low tide to avoid any spray contact to surface water.

State Environmental Quality Review (SEQR) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

Applicant is proposing to dredge two separate areas of the lake totaling approximately 20 acres. The purpose of this dredging is to maintain adequate depths (4 to 5 feet) to allow for continued recreational use of the lake. This dredging will be conducted when the lake is lowered four feet during the dam repair work. All dredged material will be removed from site and stabilized to prevent re-entry to any water body. Sediment analysis has been conducted to confirm suitability of dredge material for reuse.
