Project Description:

The Department has made a tentative determination to approve this application for a modification of the existing SPDES permit to include two additional outfalls (one existing but unused (Outfall 003) and one proposed to be newly constructed (Outfall 002) for discharge of non-contact stormwater at the facility. Piping at the plant will be rerouted to segregate flow from contact and non-contact areas, and all contact wastewaters will be routed through a treatment system and to Newtown Creek via Outfall 001. Permit conditions and limits for these discharges will remain the same as in the existing permit.

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Aug 03, 2012.

Applicant proposes to operate a temporary dewatering system to facilitate the construction of a new high rise building at 1 North 4th Place in Brooklyn with a maximum withdrawal of 1,440,000 gallons per day. Pumped groundwater is to be directed to an existing 24" private storm sewer located on-site which discharges to the East River.
