Project Description:

The New York State Department of Environmental Conservation (DEC) has received an application for a modification of a State Pollution Discharge Elimination System (SPDES) Permit, pursuant to 6NYCRR Part 750, from the currently permitted discharge of 750 gallons per day (gpd) to a proposed discharge of 1500 gpd of treated sanitary waste water to the Hudson River (Index # H, Class B). The proposed sewage treatment plant will service existing infrastructure, which formerly discharged un-treated waste into the Hudson River. These premises are being converted into a full service restaurant, and two residential apartment units.

A draft SPDES permit with DEC proposed effluent limits and monitoring requirements is available for review at DEC Region 3 headquarters in New Paltz. DEC seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. Substantive comments on these permits or requests for a hearing or both must be submitted in writing to the contact person listed below.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: Philipstown Town Planning Board

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

The applicant proposes treatment of an isolated 9.3-acre pond (NYS Water Index # H-77-P206, class B) with the aquatic pesticide Avast (active ingrediant fluridone, 41.7%) for the control of duckweed. Portions of the pond are in the adjacent area of NYS Freshwater Wetland WP-8, Class 2; no direct application to the wetland is proposed.

Project Description:

The applicant proposes removal of the invasive species common reed (Phragmites communis) within a 10.3-acre area of NYS Freshwater Wetland BR-9, Class 1. The proposal includes application of the aquatic pesticide Aquaneat (active ingredient glyphosate 53.8%) and a prescribed burn of dead biomass in dense areas, followed by pasturing of cattle and on-going monitoring. The pesticide application and prescribed burn may be repeated if necessary.
