Project Description:

The project sponsor proposes the filling of 342 square feet of NYS tidal wetland, which is classified as littoral zone on the NYS Tidal Wetlands Regulatory Map. The area proposed for fill is located beneath an existing residence which partially extends over Mamaroneck Harbor (Class B). The residence is a converted pumice mill and the area subject to this permit application historically housed the tide-powered turbines that powered the mill. Since removal of the turbines the existence of the remaining cavity has subjected the foundation of the residence to wave action, thereby compromising its structural integrity. The current proposal includes the construction of a seawall to isolate the cavity from Mamaroneck Harbor; the backfilling of the existing cavity which would be located behind the newly proposed seawall; and the raising of an existing 38 linear foot section of seawall to prevent future flooding of the residence during times of storm surge. Proposed as mitigation for the proposed filling is the removal of approximately 400 square feet of abandoned and deteriorated floats from the intertidal waters of Sheets Creek in Hempstead Harbor, on lands owned by Nassau County. The mitigation site is comparable to the proposed fill area in that it is sandy intertidal habitat.

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.
