Project Description:

The applicant proposes to add 9.1 acres to its existing 942 acre Country Side Sand & Gravel Route 62 Site mine for the purpose of sand and gravel mining, with no changes to its current mining methods. The reclamation objective for the expansion area will be to reclaim it to a lake contiguous with the larger lake to the south. The existing mine is located to the east side of NYS Route 62, south of the hamlet of Markhams, and north of the intersection with Leon Road, in the Town of Dayton, Cattaraugus County. The expansion area is part of an 18 acre parcel which is contiguous and to the north of the existing permitted mine.

Project Description:

The Department has received a request from Life Technologies to modify their SPDES wastewater discharge permit to extend the compliance date for the Alternatives Evaluation Engineering Report due to a problem with their former lab and to change the permit limit for bis (2-ethylhexyl) phthalate from the water quality standard to the practical quantitation limit (PQL). The limit for bis (2-ethylhexyl) phthalate is incorrect in the current permit. The current limit of 0.68 micrograms/L is the water quality standard for a Class B stream. This limit is below the PQL for EPA approved methods. Department policy states that when a water quality standard is below the PQL, the PQL becomes the limit. The proposed limit is the PQL for this compound using EPA Method 625, which is 10 micrograms/L. The new date for the Alternatives Evaluation Engineering Report, January 1, 2014, will coincide with the 5 year SPDES renewal application. The facility is located on Staley Road and is permitted to discharge up to 144,000 gallons per day of treated process wastewater to a Class D unnamed tributary of Big Six Mile Creek.

The Department has made a tentative determination to approve this modification. As a tentative determination, the Department is seeking public comment prior to making a final decision on permit issuance. A draft permit is available for review.
