Project Description:

The Department has made a tentative determination for a modification of a permit for an existing discharge of 432,000 gpd of treated stormwater wastewater and remediation system wastewater from a treatment system consisting of oil/water separation, granular activated carbon and air stripping to Head of Bay at the applicant's facility located at Motiva Enterprises LLC, Long Island Terminal, 74 East Ave., Lawrence NY. New information recently submitted to the department indicates the permit should be modified to include a limit for flow, sampling for 1,2,4-Trimethybenzene, Ethanol, Chrysene, Flourene, Naphthalene and Pyrene, Styrene, Cumene,and Isoprene and the elimination of sampling for MTBE at two outfalls and in the event of tank testing. Project Description:

Applicant proposes to subdivide an 8.45 acre area with frontage on Lake Montauk consisting of two parcels into three lots for future residential development. The three proposed lots will be 134,274 square feet, 132,966 square feet and 127,867 square feet, respectively in area, and as such, meet or exceed the applicable minimum lot area and wetland setback requirements of the Tidal Wetlands Land Use Regulations. Three small areas of prehistoric stone artifacts have been identified on one of the proposed lots. These artifacts will be recovered for study by a professional archaeologist before any construction related disturbance occurs. The site is located on the west side of Star Island Road across the street from the Montauk Yacht Club. SCTM # 0300-6-4-7 & 20 and 033-12-1-8.1.

State Historic Preservation Act (SHPA) Determination:

Based on the information provided in cultural resources survey reports for this project, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have an impact on registered or eligible archaeological sites or historic structures. Measures have been undertaken in consultation with OPRHP to avoid or mitigate impacts to registered or eligible resources. These agreed upon measures conclude the SHPA review.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
