Project Description:

The New York State Department of Environmental Conservation (DEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY0027961), pursuant to 6 NYCRR Part 750-1.18, and 750-1.19, the Priority Ranking System known as New York State's Environmental Benefit Permit Strategy (EBPS). This modification will also serve to renew the SPDES permit, the term of which was extended under the State Administrative Procedures Act (SAPA).

The City of Dunkirk Wastewater Treatment Plant provides primary treatment for a design flow of 6.0 mgd. Preliminary treatment consists of bar screening, grit removal, and sedimentation tanks. Biological secondary treatment consists of aeration tanks, and final clarifiers, chlorination and dechlorination. Sludge is hauled to landfill. The facility has surface discharge into Lake Erie, a class A-Special water.

The following changes to the permit are proposed: -The Responsible Official/Agent has been updated on page 1. - Mercury limit was added and the corresponding Mercury Minimization Program requirements are listed on page 13. - Combined Sewer Overflows Long Term control Plan was updated. - Stormwater Pollution Prevention Plan for POTWs was added. - Page 17 includes the short form for the Discharge Notification Requirements. - The Monitoring Location Map was updated.

Project Description:

The Department has prepared for public notice a draft renewal of a Title V air pollution control permit for Republic Engineered Products, Inc. (Republic). Republic manufactures SBQ Bar and Coil Bar steel products, primarily for the automotive industry, at its Lackawanna, NY facility. This facility is a major source for Carbon Monoxide (CO) and Oxides of Nitrogen (NOx). Currently, the emissions rate of CO is below the level that would require further emission reductions. NOx emissions are limited via 6NYCRR Part 227-2 for the two large boilers and 6NYCRR Part 216.5 for the reheat furnace. This permit will contain the monitoring and recordkeeping requirements necessary to demonstrate that Republic is in continuous compliance with that limit. There is also one 32 mmBtu/hr natural gas boiler that Republic rents for supplemental heat. Due to ducting constraints, this boiler can not exceed 20 mmBtu/hr.

In accordance with 6 NYCRR Part 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6 NYCRR Part 201.

Project Description:

The applicant proposes to excavate areas approximately 30 feet wide, 60 feet long and up to 10 feet deep to inspect and, if necessary, repair sections of pipeline at 3 mileposts in the Town of Grand Island. The proposed work areas are within New York State Freshwater Wetlands BW-9, TW-16, and TW-27 and their regulated 100 adjacent areas, which are all within the Town of Grand Island. All work will be performed along the pipeline right of way, within permanent easements and all disturbed areas will be seeded and mulched. Proper sedimentation and erosion controls will be utilized to maintain the water quality of the wetland.

The Department has made a tentative determination to approve this application. As a tentative determination, the Department is seeking public comment prior to making a final decision on permit issuance.
