Project Description:

The applicant proposes to remove the existing concrete dam (#201-0599) at Power Pond; restore approximately 1,150 LF section of Chubb River between the dam and St Rte 73 back to natural conditions, and relocate the trunk sewer line from beneath the impounded pond. The project also includes a Chubb River trunk sewer line crossing, to be installed in a 42" diameter steel casing pipe. The river restoration designed by US FWS involves stabilization with large boulders and stream flow control structures (Cross Vanes and J-Hooks) to establish grade control, prevent stream bank erosion, facilitate sediment transport, and enhance fish habitat. Boulders will also be placed in the river bed and along banks with planting of a vegetative buffer on both sides of the river. The dam demolition will be done in two phases, involving approx 400 CY of concrete removal. A portion of the right and left abutments will remain in place, reinforced with boulder protection. A steel cofferdam (installed at elevation 1700') will be used for sediment control during Phase I. Approx. 3,000 CY of sediment will be removed from the impounded area. An access ramp (300 CY) will be constructed for sediment removal. The water level above Mill Pond Dam located upstream will be lowered up to 4' for a short time during construction activities. Removal of the dam will create approx 5 acres of upland area, which will be revegetated and restored, including creation of a .8 acre wetland area with an overflow pipe to Chubb River. The Village is considering future use of the upland area as Open Space or Public Park. The project is also under review by APA (#2011-211).

A Structural-Archaeological Assessment Form has been completed. The proposed activity will not impact on registered, eligible or inventoried archaeological sites or historic structures.

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The applicant proposes an existing discharge of up to 0.28 MGD of treated sanitary wastewater to Lake Champlain, a Class A waterbody, from a secondary treatment plant at the applicant's facility located at 126 Dudley Rd, Westport. The applicant plans to modify their frequency for pH, Settleable Solids, and temperature from daily to weekly; modify their sampling type for BOD & TSS from 4-hour composite to grab; modify the sampling period for all parameters except Flow from year-round to seasonal (Flow shall continue to be monitored year-round); add a Total Phosphorus monthly monitoring requirement; and add a Total Residual Chlorine maximum limit of 2.0 mg/l.
The Department has made a tentative determination to issue a permit for a State Pollutant Discharge Elimination System permit under Article 17 of the Environmental Conservation Law. This tentative determination indicates that the discharge regulated under this statue is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of the activity for which a permit is sought. SPDES #NY-009 2983.

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.
