Project Description:

The New York State Department of Environmental Conservation (DEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY0165921), pursuant to 6 NYCRR Part 750-1.18, and 750-1.19, the Priority Ranking System known as New York State's Environmental Benefit Permit Strategy (EBPS). This modification also includes a permittee initiated modification to increase the daily discharge flow rate of outfall 001 from 0.04 MGD to 0.1 MGD. The classification of the receiving waterbody, Quassaick Creek has also changed from Class D to Class C.

Chadwick Lake Water Filtration Plant treats backwash wastewater from filters using two sludge lagoons.

The following changes to the permit are proposed: -Permit pages have been renumbered and reordered. Permit pages and conditions have been updated and reflect current Department guidance, format and nomenclature. - The footnotes for the Permit Limits, Levels and Monitoring pages have been updated and reordered. - Outfall 003 has been removed from the permit. - For Outfalls 001, 002, 004, and 005: The effluent limit for pH has been changed from a range of 6.5 - 9.0 to 6.5 - 8.5; The total residual chlorine (TRC) limit has been changed to 0.02 mg/l; The existing limit of 0.05 mg/l will remain in effect as an interim limit until the construction of facilities to achieve compliance with the final limit of 0.02 mg/l for TRC in accordance with the schedule of compliance; Interim limits at 0.04 MGD and final limits at the 0.1 MGD flow for outfall 001 have been added. -A short term high intensity monitoring schedule has been added. - A compliance schedule has been added for TRC limit in order to meet the new effluent limit of 0.02 mg/l. - A Best management Practices requirement has been added.

Project Description:

The Department has prepared a Draft Title V Permit modification 1 for the Metal Container Corp facility pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law and Title V of the Federal Clean Air Act Amendments. Metal Container Corp, located in the Town of New Windsor, Orange County, New York, operates an existing facility which manufactures two piece aluminum beverage cans.

Permit modification 1 consists of a combination of permit actions. The first component relates to the certification of Emission Reduction Credits (ERCs). The second component of this modification consists of the retrofit installation of manufacturing equipment to produce 25.5 ounce volume beverage cans.

The Department intends to certify 195 tons of Volatile Organic Compounds (VOCs) ERCs as a result of over control related to operating a thermal oxidizer beyond the requirements of Reasonably Available Control Technology (RACT) under 6NYCRR 228. The ERCs are as requested by Metal Container Corp and apply to emission unit U-2000, back end beverage can manufacturing. In support of certify the ERCs, the permit modification limits emission unit U-2000 backend manufacturing potential VOC emissions to less than 326 tons per year. The permit modification also requires Metal Container to operate the thermal oxidizer as VOC control in addition to utilizing 6NYCRR 228 RACT compliant coatings.

Metal Container Corp is proposing the installation of a manufacturing line capable of producing cans up to 25.5 ounces in volume. The new manufacturing is designated as the Big Can Line which will be installed in place of the existing Line 4 front end and the existing line 3 back end. The change requires the retrofit and removal of existing equipment, the installation of new equipment as well as coincidental equipment changes to the finishing systems and conveyors. The Big Can Line will replace a portion of the existing 12 ounce volume can manufacturing capabilities resulting in a project VOC emission potential of 93.8 tons per year. In accordance with the requirements of 6NYCRR Subpart 231-6, the Big Can Line modification is subject to nonattainment new source review (NNSR) for VOC. Based on the applicability of NNSR, the facility will utilize 107.9 tpy of VOC ERCs to comply with the rule. The source of these ERCs is the Metal Container Corp. as described above. The permit contains numerous monitoring, recordkeeping and reporting requirements conditions under 6NYCRR Subpart 231 which reflect a NNSR evaluation relative to the operation of the Big Can Line project.

The Standard Industrial Classification Code for this facility is 3411 - Metal Cans and Shipping Containers.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Project Description:

The Department has made a tentative determination to approve this application for modification of SPDES permit # NY 016 6545 for the Mountain Crest Mobile Home Park at 46 Mountain Crest Homes Road, Mountain Dale, NY, for the discharge of treated sanitary waste to a tributary of Sandburg Creek, NYS WIN # H-139-14-38-20-1, Class B(T) from Outfall 001. The discharge is proposed to be increased from 10,000 gallons per day (gpd) to 24,000 gpd to allow for the construction of 24 additional mobile home units (for a total of 72 three-bedroom, double-wide units) and for the connection of flows currently discharge to the existing subsurface system, permitted under SPDES permit # NY 021 9461. The subsurface discharge will be discontinued once the new treatment system is completed and all flows are connected.
A draft SPDES permit with DEC proposed effluent limits and monitoring requirements is available for review at the DEC Region 3 headquarters in New Paltz.
