Project Description:

Anchor Glass Container Corporation has submitted an application for renewal of its Title V Facility Permit originally issued June 25, 2001, and renewed July 5, 2007, for its glass container manufacturing facility in the City of Elmira. The facility manufactures glass containers for beverage and food packaging, and has emission points exhausting 2 natural gas fired glass melting furnaces, 6 glass container forming lines, 6 vapor deposition coating lines, raw material unloading, weighing, transfer and mixing operations, inkjet printers to code containers, crushing operations for glass cullet, and shredding equipment for recycling cardboard packaging materials.

In response to the application, the Department has generated a Draft Title V Facility Permit for renewal, and made a tentative determination to issue the Draft Permit as the Renewed Permit. Operations authorized by the Draft Permit are unchanged from those authorized by the Permit issued June 25, 2001 and renewed July 5, 2007.

The facility meets the definition of a major facility in 6 NYCRR Part 201‑2.1(b)(21), and is subject to Part 201‑6 (Title V), due to emissions in excess of 100 tons per year each of: particulate matter less than 10 microns (PM-10); total particulate matter(PM); sulfur dioxide (SO2); and oxides of nitrogen (NOx).

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Comments and requests for a public hearing should be in writing and addressed to the Department representative listed below. State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Project Description:

The Department has made a tentative determination to issue a Department Initiated Modification to the Town of York SPDES permit; the expanded plant has been operating under interim limits for 12 years. Although the permit issued on June 30, 2000 included final limits, they were never authorized by the Department. The modification will authorize the final limits and the new flow rate of 0.3 million GPD (increased from 0.12 million GPD) for the expanded wastewater treatment plant, and will correct the loading limits for CBOD5 and Total Suspended Solids (TSS). The proposed draft permit includes increased lbs/day loading limits for CBOD5 and TSS, correctly calculated based on the 0.3 million gallon per day (GPD) flow rate. The draft includes increased monitoring for TSS and CBOD5. As a tentative determination, the Department seeks public comments prior to making a final decision. The file, including the draft permit, is available for review at the NYSDEC Region 8 office.

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Jun 22, 2012.
