Project Description:

The Department has prepared a draft Title V permit renewal which incorporates operational details of the NOx RACT Plan/BART Determination and has made a tentative determination to approve the application for a Title IV Acid Rain permit for this facility. This facility consists of two multiple fuel-fired boilers rated at 5,546 MMBtu and 5,374 MMBtu. This facility also has a 615 KW emergency generator, several storage tanks for fuels, lubricating oils, and chemicals. Other sources include a boiler water treatment plant and a wastewater treatment plant. The facility is a major source for Oxides of Nitrogen, Sulfur Dioxide and Particulates/PM10/PM2.5.

By July 1, 2014 average emissions from Bowline Units 1 and 2 shall comply with an emission limit of 0.15 pounds per million british thermal units (#/MMBtu) while such units are fired with natural gas, as measured on a 30 day rolling average period for the non-ozone season and a 24 hour calendar day average period for the ozone season, excluding start-up and shut-down periods. By July 1, 2014 average emissions from Bowline Units 1 and 2 shall comply with 0.25 #/MMBtu while such units are fired with oil, as measured on a 30 day rolling average period for the non- ozone season and a 24 hour calendar day average period for the ozone season, excluding start-up and shut-down periods. Beginning July 1, 2014 GenOn shall limit oil firing to no more than 3.1 million barrels during the ozone season (May 1 through September 30) and 4.6 million barrels during the non-ozone season (October 1 through April 30). The limit for oil and gas dual fuel firing periods will be heat input weighted between 0.15 #/MMBtu and 0.25 #/MMBtu. GenOn shall install or optimize equipment for compliance with the above emission rates.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

The Department has made a tentative decision to approve an application for emission reduction credits (ERCs) for past emission reductions at the Lovett Generating Station in Tompkins Cove. The ERCs result from the permanent shutdown of the facility and surrender of corresponding Certificates to Operate for emission units 1-00001, 1-00002, 1-00003, and fugitive emissions from the coal building. The DEC intends to approve ERCs for oxides of nitrogen (NOx), volatile organic compounds (VOCs), particulate matter (PM-2.5), and sulfur dioxide (SO2) as follows:

Project Description:

The New York City Department of Environmental Protection (NYCDEP) proposes to widen King Street, in the Town of North Castle, to allow for the installation of a left turning lane onto Nannyhagen Road. The road widening and installation of the associated drainage structures will result in approximately 63 square feet of permanent disturbance to NYS Freshwater Wetland GO-10 (Class I) and .51 acre of disturbance within its 100 foot adjacent area. Also proposed is the selective cutting of trees, located within the 100 foot adjacent area, which will pose a safety risk after the road widening is completed. An Invasive Species Management Plan will be implemented for areas located within 50 feet of the work area. Also proposed are temporary, minor disturbances within a federally regulated wetland, associated with proposed improvements to Lakeview Avenue, located in the Town of Mount Pleasant.
