Project Description:

The New York State Department of Environmental Conservation (NYSDEC) has reviewed the Hazardous Waste Management Permit (6NYCRR Part 373) renewal application for the General Electric Buffalo Service Shop (GE), and has made a tentative determination to issue the permit which consists of cleanup actions to address residual contamination. The permit will require that GE continue implementation of corrective measures to ensure protection from exposure to soils contaminated by polychlorinated biphenyls. The final corrective measures were selected because NYSDEC determined that when implemented, the activities will be protective of human health and the environment. All hazardous waste units have been properly closed according to the facility's 6NYCRR Part 373 permit and NYSDEC closure procedures. Comments from the public will be considered in issuing the final permit, and a notice of decision will be sent to each person who submits written comments or who requests such notice. A public hearing will be scheduled if warranted based on comments received. In addition, any person may request a public hearing. The request must be made in writing, stating the nature of the issues proposed to be raised in the hearing and be submitted to the contact person no later than the last date for public comment. Persons interested in the facility's operation can submit a written request to the contact person to be put on this Department's mailing list. The draft permit, application and fact sheet are available for public review during normal business hours at NYSDEC, Division of Environmental Permits, 270 Michigan Avenue, Buffalo, NY and NYSDEC, Division of Environmental Remediation, 625 Broadway, Albany, NY. Copies of the documents are also available at the Parkside Village Branch Library, 169 Sheridan Parkside Drive, Tonawanda, NY, 14150.

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The proposed project involves the re-establishment of the original drainage channel of Spring Brook, a Class C(TS) stream and work within NYS Wetland BL-7. The purpose of the work activity is to improve drainage by clearing the channel of blocked material that causes runoff to back up on the Davis Valley Farm property. The re-established channel will be approximately 400 linear feet long, 2 feet wide (bottom width) and 1-1.4 feet deep. The Department has made a tentative determination to approve this application and is seeking public comment prior to making a final decision on permit issuance.

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:
