Taylor Pond Management Complex Draft Unit Management Plan/Public Meeting

The New York State Department of Environmental Conservation (NYS DEC) has completed this Draft Unit Management Plan (UMP) for the Taylor Pond Management Complex. Key proposals in the Draft UMP include: create parking for and officially designate trail to the top of Catamount Mountain; provide new parking for trail to Poke-O-Moonshine fire tower; create new parking area for the Military Pond trail; classify snowmobile trail system to better connect local communities; and designate group camping sites at Union Falls Pond and Franklin Falls Pond along Northern Forest Canoe Trail.

A public meeting will be held on Thursday, May 24, 2012 at 6:30 p.m. at the Town of Jay Community Center, 11 School Lane, Ausable Forks, NY. Comments are welcome and will be accepted by the contact person until June 29, 2012. The Draft Unit Management Plan is posted on the NYS DEC website at: http://www.dec.ny.gov/lands/75834.html.

Copies of the plan will also be available on CD at the following locations: NYS DEC's Headquarters in Albany, NY (5th floor); NYS DEC's Region 5 office in Ray Brook NY; NYS DEC's Region 5 Sub Office in Warrensburg, NY; the offices for the Town of Franklin in Franklin County; the Towns of Black Brook, Ausable, Peru, and Saranac in Clinton County; and the Towns of Chesterfield, Elizabethtown, Essex, Jay, Lewis, St. Armand, Westport and Willsboro in Essex County.

The Taylor Pond Complex is located in the Towns of Ausable, Black Brook, Peru, Saranac, Chesterfield, Elizabethtown, Essex, Jay, Lewis, St. Armand, Westport, Willsboro, and Franklin in the Counties of Clinton, Essex and Franklin, New York.

Project Description: The project involves the installation of an 11 foot long, 16 foot wide, personal watercraft platform in accordance with plans. A variance is required.


Negative Declaration

Clinton County - The Town of Peru, as lead agency, has determined that the proposed Adoption of Town of Peru Zoning Law will not have a significant adverse environmental impact. The action involves the adoption of a Zoning Law for the entire Town of Peru to replace an existing and out of date zoning ordinance that was first adopted in the early 1970's. The proposed zoning law is consistent with the Town of Peru Comprehensive Plan that was adopted by the Town in 2006. The proposed zoning law was drafted with the assistance of a private consultant and with the input and guidance of a group of volunteer citizen residents of the Town of Peru. The draft zoning law includes revisions to the zoning map and a list of allowable and prohibited uses, and new overlay zoning districts for agriculture, historic structures, planned unit developments, and public water supply watershed area. The draft zoning law also includes new zoning districts for commercial use, neighborhood commercial use, and Adirondack Park areas. The zoning law was designed and drafted to protect significant and/or vulnerable resources in the Town as well as allowing for orderly growth and development. The project is located throughout the Town of Peru, New York.

Franklin County - The New York State Department of Environmental Conservation (NYS DEC), as lead agency, has determined that the proposed Crestline Sand and Gravel will not have a significant adverse environmental impact. The action involves a proposal by the applicant for a new, 20.86 acre sand and gravel mine. The site is part of a 128 acre parcel owned by the applicant. Operations will include onsite screening. Concurrent reclamation will occur as areas are mined. Upon completion of mining, the entire site will be reclaimed, with 2 horizontal to 1 vertical side slopes and grasses and woody vegetation re-established. The project is located on the west side of NYS Route 30, approximately 3,000 feet south of the Town line Road intersection in the Town of Malone, New York.

Fulton County - The Town of Johnstown Planning Board, as lead agency, has determined that the proposed CG Roxane Spring Water Bottling Facility will not have a significant adverse environmental impact. The action involves a proposal by CG Roxane, LLC to construct a 242,000 ± square foot water bottling facility. The project will be constructed in two (2) phases with Phase I involving the construction of a 176,557 ± square foot facility, and Phase II involving the addition of a 65,545 ± square foot expanded facility. Associated driveways, parking areas and a truck entrance drive will be constructed as part of this project, along with a stormwater retention system on the project site. Additionally, Old Sweet Road will be redeveloped to the Town of Johnstown standards. The new water bottling facility will be located on a 7 -acre parcel, located in an RA-Residential Agricultural Zone. The proposed use is classified as an agricultural processing plant and required a site plan review by the Planning Board. The applicants own an additional 400 ± acres of property adjacent to the proposed water bottling site. The project is located on 325 Watershed Road, along the south side of Watershed Road in the Town of Johnstown, New York.

Hamilton County - The Hamilton County Industrial Development Agency (IDA), as lead agency, has determined that the proposed Installment Sale of Oak Mountain Ski Area to Kevin O'Brien, et al will not have a significant adverse environmental impact. The action involves the conveyance of the Oak Mountain Ski Area from the Hamilton County IDA to Kevin O'Brien, Matthew O'Brien, Laura O'Brien and Elizabeth O'Brien via an installment sale agreement. Oak Mountain Ski Area is located on approximately 230 acres and also includes the conveyance of a 0.4 right of way from Elm Lake Road to the Ski Area. The installment sale agreement requires Kevin O'Brien, et al to meet certain performance requirements, including continued operation of the premises as a ski area, cash investments and job retention or creation. The installment sale agreement requires the Hamilton County IDA to convey the premises to Kevin O'Brien, et al upon the expiration of two years and so long as Kevin O'Brien, et al remains in compliance with the terms of the installment sale agreement. Said agreement also provides for a sale of the ski area to a third party and a percentage split of the net proceeds of the salvage value sale depending on the date of said sale between Kevin O' Brien, et al and the Hamilton County IDA. The project is located on Elm Lake Road in the Village of Speculator, Town of Lake Pleasant, New York.
