Project Description:

The applicant proposes to construct a two story, 96 unit, assisted living residence facility and stormwater management pond on a 9.5 acre parcel located west and adjacent to 1400 Westfall Rd., in the Town of Brighton. The stormwater pond will have a buried outfall pipe with splash guard that will extend approximately 90 lineal feet into the adjacent area of the state regulated freshwater wetland, BR-9.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: Brighton Town Planning Board (Monroe Co)

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. The report of the survey is on file. No archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than May 18, 2012.

Project Description:

The Department has received an application from Cold Spring Construction Company for a 39 acre expansion of its sand and gravel mine on Jones Road. The current permit authorizes operation in a 54.5 acre life of mine area. The expansion proposed will increase the life of mine area to 93.5 acres.

The expansion will continue current operations at the site over a larger area. Expanded mining operations will enlarge the pond within the current life of mine area northward into the expansion area. Sand and gravel will continue to be mined from above and below the water table by an excavator and drag line, and be processed by crushing and screening. Maximum processing capacity is 150 tons per hour.

Excavation is proposed to remove approximately 600,000 cubic yards of sand and gravel from the expansion area. Grading towards the excavation will retain storm water runoff within the mined area. No off site discharge of storm water runoff is proposed. There are no NY State regulated streams or freshwater wetlands within the mine or the 39 acre expansion area.

Up-land reclamation surrounding the enlarged pond will include the replacement of stockpiled topsoil, and re-seeding with an approved seed mixture.

The project site is located on the Cold Spring Construction Company properties bounded on the east by State Forest, private woodlands, and the Syracuse Sand and Gravel's Gang Mills Pit, the east and south by Jones Road and the north by privately owned fields and wet scrub/woodlands.

The complete application is available for review at the Region 8 NYSDEC office, and a copy of the application materials has been sent to the Town of Erwin.

Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
