Pursuant to the Environmental Conservation Law sections 11-0303, 13-0105, 13-0340-b, 13-0340-e and 13-0340-f, the New York State Department of Environmental Conservation (NYS DEC) hereby gives notice of the following:

Notice of Emergency Adoption and Proposed Rule Making to amend 6 NYCRR Part 40 pertaining to recreational summer flounder, scup, and black sea bass regulations. This rule making will decrease the minimum size limit for summer flounder to 19.5 inches and increase the possession limit to 4 fish. For scup the recreational season will increase to the period from May 1 through December 31 and the possession limit will increase to 20 fish. For anglers on board licensed party and charter boats, there is a bonus season from September 1 through October 31 during which the scup possession limit will increase to 40 fish. For black sea bass the recreational season will increase to the period from June 15 through December 31. The possession limit will increase to 15 fish.

This notice will be published in issue 18 of the State Register, dated May 2, 2012.

Notice of Adoption

6 NYCRR Part 219, Incinerators
6 NYCRR Part 200, General Provisions

Pursuant to Environmental Conservation Law (ECL) Sections 1-0101, 3-0301, 3-0303, 19-0103, 19-0105, 19-0107, 19-0301, 19-0302, 19-0303, 19-0305, 71-2103, and 71-2105; and Sections 111 and 129 of the Clean Air Act; 40 CFR 60, Subpart MMMM "Emission Guidelines and Compliance Times for Existing Sewage Sludge Incineration Units", and the New York State Department of Environmental Conservation (NYS DEC) hereby gives notice of the following:

Notice of Adoption of Rules on April 12, 2012, to be effective May 12, 2012, to amend existing Title 6 of the Official Compilation of Codes, Rules and Regulations of the State of New York (NYCRR) Part 219, Incinerators; and Part 200, General Provisions.

This rulemaking adopts a new Subpart 219-9, which applies statewide to existing sewage sludge incineration units constructed on or before October 14, 2010. NYS DEC incorporates by reference the requirements of 40 CFR Part 60, Subpart MMMM into 6 NYCRR Part 200, and adds a new 6 NYCRR Subpart 219-9 with specific requirements.

The regulation will establish mandatory limits for nine air pollutants: particulate matter (PM), sulfur dioxide (SO2), hydrogen chloride (HCl), nitrogen oxides (NOx), carbon monoxide (CO), lead (Pb), cadmium (Cd), mercury (Hg), and dioxins/furans; it also establishes specific requirements for initial and annual performance testing, operator training, recordkeeping and reporting, and compliance monitoring.
