Project Description:

The applicant proposes a 1.6 acre expansion to the currently permitted life-of-mine limits at the Newton Sand and Gravel Mine. The modification will increase the previously permitted acreage of 16.2 acres owned by the applicant at this location on NYS Route 60 in the Town of Gerry. The modification includes the addition of a stockpile area and a new haul road (existing railroad bed) connection to the Maloy gravel mine located south of the Newton Mine on NYS Route 60. Upon reclamation of the site, a deep freshwater pond is proposed. The Department has made a tentative determination to approve this application and is seeking public comment prior to making a final decision on permit issuance.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was performed.

SEQR Lead Agency: NYS Department of Environmental Conservation

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than May 25, 2012.

Project Description:

The Department of Environmental Conservation (DEC) has prepared a draft permit and has made a tentative determination to issue a renewal to State Pollutant Discharge Elimination Systems (SPDES) permit (NY#0001368) for the discharge of stormwater and non-contact cooling water to Blasdell Creek - North Branch, a class C water.

Great Lakes Industrial Development LLC (GLID) is undertaking minor facility upgrades and repairs in anticipation of future leasing or sales opportunities. Presently, no active production operations take place on the property.

DEC proposes to incorporate the following modifications to this permit: -Administrative changes have been made to the first and last page of the draft permit, forms have been updated incorporating the latest general conditions. -Outfall 134 has been removed from permit based on recent inspections of the facility that the outfall does not lie within the GLID property. -Effluent limits for parameters have been revised for Outfall 132 and 139: -The Receiving Water for MP 215 and MP 224 has been clarified. -The Wastewater Types for Outfalls 132, 139, and MP 224 have been updated. -The pH range for MP 215 has been modified from 6.0 9.0 to 6.5 8.5. -For MP 215, the flow sample type has been changed to Instantaneous, and the sample types for parameters has been modified to Grab. -The Special Conditions - Best Management Practices page has been modified to have the submission date of the most recent BMP plan. -The Schedule of Compliance page has been removed.

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
