The applicant proposes a new, 3.4 acre mine for the purpose of providing clay material for construction of a new cell at the existing Clinton County Landfill in Morrisonville. The site, located on the north side of Cemetery Road approximately 0.5 miles west of the Point Au Roche Road intersection, is part of a 230 acre parcel owned by Chris Fessette. The short-term operation is expected to be completed in six months. Upon completion of mining, 2.5 acres will become part of the existing, adjacent farm pond and the remaining upland portions, including the haul road, will be seeded/vegetated.

The Department has prepared a draft permit and has made a tentative determination to issue a modification Title V Air Facility Permit to incorporate new Oxides of Nitrogen Reasonably Available Control Technology (NOx RACT) limits as required by 6 NYCRR 227-2.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Project Description:

The Department has prepared a draft permit and has made a tentative determination to approve a Reasonably Available Control Technology (RACT) plan for the control of Nitrogen Oxide (NOx) emissions from the facility's power boiler. The plan proposes combustion modifications which will reduce emissions to a rate of 0.23 pounds of NOx emissions per million BTUs. The facility's Title V permit will be modified to reduce the current limit to the proposed lower figure, effective no later than July 1, 2014. These emissions are monitored by a Continuous Emission Monitoring System (CEMS) and the status reported to the Department semi-annually. The permit is otherwise unchanged from the current version which was issued March 19, 2012.
