Negative Declaration

Cattaraugus County - The New York State Department of Environmental Conservation (NYS DEC), as lead agency, has determined that the proposed Case Brothers, Inc. - Knapp #27 will not have a significant adverse environmental impact. The action involves a proposal by Case Brothers, Inc. for an oil well, known as the Knapp #27. The project utilizes an existing access road to the site to eliminate any impact from a new road construction. A well pad area 100 foot x 60 foot will be cleared for the drilling of the well and an approximate 30 foot x 30 foot area will be maintained after construction, with the remainder of the well site restored by grading and revegetation. The project is located approximately 1,250 feet north of Nichols Run Road and 2,800 feet east of Main Street in Limestone, Town of Carrollton, New York.

Chautauqua County - The Town of Busti Town Board, as lead agency, has determined that the proposed Adoption of Local Law #1 - Regulating Self-Storage Facilities in the Conservation-Agricultural District will not have a significant adverse environmental impact. The action involves the adoption of a local law to allow by special use permit self-storage facilities on certain qualifying parcels in the Conservation-Agricultural (C-A) District in the Town of Busti. The project is located in the Conservation-Agricultural (C-A) District of the Town of Busti, New York.

Erie County - The Town of Amherst Planning Board, as lead agency, has determined that the proposed Mixed-Use Development will not have a significant adverse environmental impact. The action involves the redevelopment of a 2.29 ± acre parcel of land currently occupied by the Stereo Advantage facility as a hotel/mixed-use project. The project includes demolition of the existing building and construction of a 6 ± story building comprised of a 111 ± room (including 18 suites) hotel, 40 ± apartments, 3,270 ± square foot of first floor restaurant space and 3,608 ± square foot of retail space along with 2 levels of indoor parking (231 ± total parking spaces). The total gross square footage of the project is proposed as 234,185 ± square foot. The petitioner is Ellicott Development Company, 295 Main Street, Suite 210, Buffalo, NY 14203. The project is located 5195 Main Street & 36 South Forest Road in the Town of Amherst, New York.

Notice of Acceptance of Final GSEIS

Erie County - The Town of Hamburg Town Board, as lead agency, has accepted a Final Generic Supplemental Environmental Impact Statement on the proposed Lake Erie Commerce Center. The Final SGEIS is available from the Town of Hamburg Planning Department or Office of Town Clerk, 6100 South Park Avenue, Hamburg, NY and on line at: http://www.townofhamburgny.com/Important_Town_Documents-117736.html.

The action involves an application from the Hamburg New York Land Development Company for the approval of Pre-Permitted Site Designation for approximately 134 acres of land. The objective of these actions is to satisfy the SEQR requirements for the project site through the preparation of a generic environmental impact statement, thereby allowing future proposed projects within the Lake Erie Commerce Center to proceed directly to the Town for site development and building permits.

The project area, formerly known as the Lake Erie Industrial Park, was the subject of a previous SEQR review that included the preparation of a Generic Environmental Impact Statement (GEIS). The SEQR process for that project was completed in 1999. In accordance with the Town of Hamburg Pre-Permitted Site Incentive Law, pre-permitted site designation for properties previously reviewed under SEQR requires the preparation of a Supplemental GEIS.

The project is located on Bayview Road, east of NYS Route 5 in the Town of Hamburg, New York.
