Project Description:

Center Aggregates Corporation proposes to add a wash plant to the current crushing and screening material processing operations at its 70 acre sand and gravel mine on Pavilion Center Road in the Town of Pavilion. Process water will be obtained from temporary ponds to be dug at the site. Used process water from a supply pond will be directed to settling ponds to contain any fine suspended materials, and will be re-used in a closed loop process.

No other changes are proposed for the mining operation. Final reclamation will convert the site including the ponds to agricultural land and will include the replacement of stockpiled topsoil and seeding to establish a vegetative cover.

Project Description:

CSX Transportation, Inc. (CSXT) proposes to dismantle and remove the Hojack railroad swing bridge (a structure eligible for inclusion in the NY State and Federal Register of Historic Places), located at milepost .9 in the Genesee River in the City of Rochester Monroe County, New York down to elevation 217.3 feet including the removal of approximately 5000 cubic yards of sediment. The US Coast Guard is requiring that the bridge be removed because it is a structure in a navigable waterway that has not been used for rail traffic since approximately 1995. The sediment located north of the central pier will be over dredged by 0.5 feet and will then be covered with class A (noncontaminated) sediment to be moved during the demolition process to abate aquatic exposure to the class C sediment. All class C sediments (and any remaining Class A sediments) will be sent to the federal US Army Corps of Engineers Confined disposal site (CDF) No. 4 in Buffalo New York. The applicant also estimates that 1200 cubic yards of construction and demolition debris will be disposed of at an off-site permitted facility. The two abutments associated with the bridge located on the banks of the Genesee River are owned by different entities. The Eastern abutment is owned by capital FRS properties, LLC and will be removed in part under a separate permit action. The Western abutment will be left in place. A Historic Mitigation Plan and Draft Letter of Resolution have been prepared to help mitigate the loss of a significant historic resource. The Department seeks comments on the application prior to making a final decision. The file is available for review at the NYSDEC Region 8 Office in Avon, NY.

Measures have been undertaken in consultation with OPRHP to avoid or mitigate impacts to registered or eligible resources. These agreed upon measures conclude the SHPA review.

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The Department has received an application from the Steuben County DPW to develop and operate a new 11.2 acre surface gravel mine within a 96.88 acre property in the Town of Avoca. The mine site is located on the John Strait property, on the east side of Waterbury Hill Road. The mine entrance will be located approximately 400 feet south of the intersection of Fairbrother Road.

The mine will involve surface excavation by bulldozer and front end loader, and is proposed to eventually remove 450,000 cubic yards of sand and gravel from the mine site, over an unspecified operational life. Excavated materials will be processed on the pit floor by crushing and screening equipment. Processed material will be stockpiled for loading onto trucks. Topsoil and overburden will be stockpiled in a perimeter berm around the area to be excavated, and seeded for later use in site reclamation. Mining is not proposed to a depth below the local water table.

Hours of operation proposed are 6 AM to 4:30 PM Monday through Thursday, with no work on weekends or holidays. Final reclamation partly to agricultural land and partly allowed to revert to brush and woods is proposed, and will include the replacement of stockpiled topsoil and seeding.

Plans show grades that will retain storm water runoff within the mined area and allow infiltration into the soil. No off site discharges are proposed. There are no streams or NY State regulated freshwater wetlands within the Life of Mine area.

The application is available for review at the Region 8 NYSDEC office, and a copy of the application materials has been sent to the Town of Avoca.

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
