Project Description:

E. Tetz & Sons, Inc. proposes to increase the depth of excavation over the previously approved 54.5 acre sand and gravel mine situated on 73.6 acres controlled by the permittee. The current approved plan allows mining to an elevation ranging from 566 to 588 feet. The modification proposes mining to a final floor elevation ranging from approximately 544 to 537 feet; therefore, increasing depth of excavation by an average of approximately 37 feet over the previously approved life of mine area.

Approximately 3.1 million cubic yards of sand and gravel will be removed from this site over the life of the mine. On site processing via closed-circuit washing and crushing will continue to be conducted. Reclamation of the mined area will consist of grading and placement of topsoil, and reseeding the floor. The stated reclamation objective is open space.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: NYS Department of Environmental Conservation

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Project Description:

The Department has prepared a Draft Air State Facility permit for the Bedford Hills Correctional Facility located in Westchester County, NY. The facility is capping its total NOx emissions below 25 tons/yr and out of Title V requirements. To meet its heating needs the facility operates a 115 MMBtu/hr powerhouse which includes four dual fired boilers capable of firing natural gas and No. 2 fuel oil (one 49.93 MMBtu/hr, two 25.1 MMBtu/hr, and one 14.6 MMBtu/hr). The facility also operates a 500 kw natural gas engine to supplement the boilers and three diesel generators (one 1000 kw and two 1500 kw) used in an energy demand response program and for emergency power. Other sources of emissions include exempt generators, storage tanks and maintenance and vocational activities.

Persons wishing to inspect the subject Air State Facility files, including the application with all relevant supporting materials, the Draft Permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and comments received on it to determine whether to hold a public hearing. Comments and requests for a Legislative Public Hearing should be in writing and addressed to the Department representative listed below.
