Project Description:

The applicant proposes to add 37.65 acres of land consisting of 25.6 contiguous acres to the east and 12.05 contiguous acres to the north to its permitted 203.1 acre Borer Deposit/Freedom Plant. Sand and gravel will be transported to the existing processing plant via a field hopper. The reclaimed contours will be a continuation of the previous reclamation contours for the Borer Deposit pit and adjacent Town of Freedom pit. The reclamation objective for the east acreage is wildlife habitat/open space; and the north acreage is to a condition suitable for agriculture. No other changes to the existing operation are proposed.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: NYS Department of Environmental Conservation

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Apr 20, 2012.

Project Description:

The Department has received an application for the replacement of 2,720 feet of sanitary sewer main between the Attica/Wyoming Correctional Facility screening building No. 48 and the Village of Attica sanitary sewer system. The project involves work with NYS regulated freshwater wetland AT-1 and a crossing of Baker Brook, a class A waterbody. Appropriate sedimentation and erosion controls will be utilized to maintain the water quality of the wetland and the stream. Cofferdams will be used to pump the stream around the work area and maintain downstream flow. Native stream bed material and wetland soils will be stockpiled for replacement in the trench. The Department has made a tentative determination to approve this application and is seeking public comment prior to making a final decision on permit issuance.

A Structural-Archaeological Assessment Form has been completed. The proposed activity will not impact on registered, eligible or inventoried archaeological sites or historic structures.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:
