Project Description:

The New York State Department of Environmental Conservation (DEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY0110078), pursuant to 6 NYCRR Part 750-1.18, and 750-1.19, the Priority Ranking System known as New York State's Environmental Benefit Permit Strategy (EBPS). This modification also includes a permittee initiated modification to delete Outfalls 003 and 004.

Buckeye terminal is a petroleum storage and transfer facility handling gasoline, diesel fuel, kerosene and fuel oil. Discharge consists of: 1. Runoff from the tank farm, barge loading rack and truck loading rack. Runoff goes to an oil-water separator; 2. Any water used for hydrostatic testing of repaired tanks. The stormwater, any hydrostatic test water, and treated groundwater are discharged to the Barge Canal (Class B) through Outfalls 001 and 002 and the internal waste stream Outfall 002A is for any hydrostatic test water.

The following changes to the permit are proposed: - Permittee name, contact name, responsible official and mailing address were updated. - Outfalls 003 and 004 have been removed. - Monitoring requirements for parameters were added to Outfall 001. - A high intensity monitoring program was added. - Best management practices were added. - An updated flow diagram was added.

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

The Department has made a tentative determination to issue a new SPDES permit to the applicant to discharge approximately 750 gallons per day of treated effluent from a new residential sewage aeration system, which will serve an existing residence, to Salmon Creek. An Article 24 Permit is required because the project is located in the 100-foot adjacent area of Freshwater Wetland GR-1 and an Article 15 Permit is required because the discharge pipe will be located in the banks of Salmon Creek (a Class B protected stream). The Department seeks comments prior to making a final decision. The file is available for review and comment at NYSDEC Region 8.

The Department has made a tentative determination to issue a new Water Supply Permit for the Town of Gaines Water District 10 to include 21,440 LF of water line and apurtenances along Transit, Sawyer, Kent and Densmore Roads to take up to a maximum of 8,000 gallons per day from the Village of Albion's Lake Ontario Source. The project will require a 401 Water Quality Certification to cross class c streams and federal wetlands. The file is available for review and comment at NYSDEC Region 8.

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
