Notice of Waiver of RACT Requirements

The applicant manufactures medical devices and the process of coating and drying the devices creates emissions of volatile organic compounds (VOCs) to the atmosphere. Some of the processes employ coatings which do not meet the VOC content requirements of 6NYCRR Part 228 - Surface Coating Processes.

New York State Department of Environmental Conservation (NYS DEC) has received and proposes to approve a request for a waiver allowing limited use of these coatings for 3 years. The company has provided documentation that compliant coatings which meet their specific requirements are not available and that the cost of installing control devices significantly exceeds the cost threshold for Reasonably Available Control Technology (RACT).

The applicant's Air State Facility Permit contains conditions which only allow application of non-compliant coatings while using techniques that minimize emissions and which limit the quantity of non-compliant coatings that may be used.

Negative Declaration

Warren County - The Town of Queensbury Town Board, as lead agency, has determined that the proposed Amendment of Zoning Law - Chapter 179 will not have a significant adverse environmental impact. The action involves revisions to the Official Town Zoning map and the Chapter 179 of the Town Code to change the zoning of certain properties from "MS" to "O" and from "MS" to "NR", to add funeral home as an allowed use in the "CLI" zone and revise provisions relating to alternate members of the Planning Board and Zoning Board of Appeals. The project is located throughout the Town of Queensbury, New York.

Positive Declaration

Saratoga County - The Town of Ballston Planning Board, as lead agency, has determined that the proposed Dolomite Products Hot Mix Asphalt Plant may have a significant adverse impact on the environment and a Draft Environmental Impact Statement must be prepared. The action involves the construction and operation of a hot mix asphalt plant within the Curtis Industrial Park located off of NYS Route 67 in the Town of Ballston, Saratoga County, New York. The project will include the asphalt manufacturing plant, bucket elevator, batch tower, pug mill, conveyor belt, storage silo and stormwater management facilities. The project is located at 831 Route 67 in Ballston Spa, New York.
