Project Description:

The Department has made a tentative determination to issue a permit modification and variance to the existing Part 360 permit issued to Ontario County for the operation of the Ontario County Landfill. The modification includes a variance from 6 NYCRR Part 360-1.14(p)(4) which states "... Sound levels for equipment must not exceed 80 decibels (A) at a distance of 50 feet from the operating equipment" based on difficulties in adequately assessing the compliance of the equipment at these distances and other reasons. The applicant will continue to use mufflers and they contend that they will be able to meet all other noise standards and guidance. The one hour Leq sound level limit at the facility property lines will continue to be met. Noise easements will not be required. The Department seeks input prior to making a final decision. The file is available for review and comment at NYSDEC Region 8 in Avon, NY.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Mar 29, 2012.

Project Description:

The Department has made a tentative determination to issue a permit modification to Garlock Sealing Technologies LLC which discharges treated industrial wastewater, stormwater, non-contact cooling water, and boiler blowdown to Red Creek. The permit modification would authorize the facility to treat t-butyl alcohol (TBA) in its wastewater treatment plant; as such, various monitoring and an effluent limit for Chemical Oxygen Demand (COD) have been added to the draft permit as a surrogate for TBA. The Department is seeking comments prior to making a final decision. The file is available for review and comment at NYSDEC Region 8.
