Project Description:

The Department has made a tentative determination to modify the existing permit in accordance with the Department's "Environmental Benefit Permit Strategy" system. The draft permit includes modifications to the water quality based effluent limits for Total Residual Chlorine, and summer and winter limits for NH3-N. The limit for TRC is being changed from 0.1 mg/l to 0.020 mg/l. The summer limit for NH3-N is being changed from 4.0 mg/l to 3.4 mg/l and the winter limit from 12.0 mg/l to 5.1 mg/l Reference to the General Conditions was deleted and replaced with 6NYCRR Part 750. This facility is required to monitor for Total Phosphorus and Nitrogen based on the EPA Chesapeake Bay Watershed nutrient monitoring program. These modifications will protect the water quality of the subject watershed as well as bring the SPDES permit up to date and in complaince with all applicable laws and regulations. The draft permit is available for review in the DEC Cortland Office.

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Apr 06, 2012.

Project Description:

The applicant proposes to operate a new sand and gravel mine with a 34 acre Life of Mine Boundary of which 10.9 acres is proposed to be disturbed in the next 5 year permit term. The mine is located north east of the intersection of Johnson and Hanson Roads in the town of New Haven. The applicant also proposes onsite processing with a portable screening unit of less than 150 ton per hr capacity and occasional use of a portable crusher for processing oversize material.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: NYS Department of Environmental Conservation

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
