Project Description:

The New York State Department of Environmental Conservation (DEC) is pursuing a Department Initiated Modification (DIM) and renewal to the State Pollutant Discharge Elimination System (SPDES) Permit (NY0228877), pursuant to 6 NYCRR Part 750-1.18, and 750-1.19, the Priority Ranking System known as New York State's Environmental Benefit Permit Strategy (EBPS).

The Batavia Bulk Plant supplies gasoline, heating oil, diesel and kerosene. Runoff collected and drained from the concrete diked containment area for the fuel supply tanks and from the fuels loading/unloading pad, flows through a series of three oil-water separators before it is release via Outfall 001 into a ditch that is a tributary to Horseshoe Lake, a class D water.

The following changes to the permit are proposed: -Stormwater flow at Outfall 001 has been changed. - Limits for Total Suspended Solids, Settleable Solids, Total Phenols, Methyl tert-Butyl Ether and BTEX compounds for Outfall 001 have been changed.

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Project Description:

Applicant proposes to expand its existing Station 124 electrical substation by expanding the facility approximately 300 linear feet to the east. This expansion includes installation of two (2) phase shifting transformers (PST) and a Mvar Static VAR Compensator (SVC), relocation of a 34kV circuit from overhead to underground, installation of a breaker-and-a-half bus configuration, construction of a drainage swale, temporary relocation of line 911, moving a fence and extending the gravel base, and temporary installation of wood matting for operation of heavy equipment. The project requires tree clearing within State Freshwater Wetland PN-8 and filling approximately 1.32 acres of Federal and State wetlands (State Freshwater Wetland PN-10). Project also requires removal of heavy brush and temporary placement of wood matting for construction access within and adjacent to the State Freshwater Wetlands PN-8 and PN-10. Mitigation of the Federal wetland impacts is being proposed by using the Rochester's Cornerstone Mitigation Bank at a 3:1 ratio.
