Project Description:

The applicant proposes to repair a fifteen foot high earthen dam located on his property northwest of the intersection of Route 219 and Route 242. The service and auxiliary spillways are to be reconstructed which will require draining of the impoundment. The dam impounds 28.07 acre feet of water, with a surface area of 4.03 acres and has been determined to be a Hazard Class "B" structure. The application materials are available for review and comment in the regional office during normal business hours.

State Environmental Quality Review (SEQR) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue an Air State Facility permit for the Yahoo! Inc. Lockport Data Center facility. The facility consists of thirteen diesel fuel fired emergency backup generator sets and one emergency fire pump used to provide electricity in the event of a power outage. Emission sources include six 2922 horsepower (HP) internal combustion engines (ICE), one 1220 HP ICE, six 3056 HP ICEs and one 75 HP Clarke fire pump. The draft permit includes a federally enforceable emission cap that limits the hours of operation of the emergency generators to no more than 450 hours per year, per engine. This limitation will cap nitrogen oxides emissions below 100 tons per year for non-applicability to Title V and New Source Review. Yahoo! has demonstrated the engines satisfy the applicable emission standards for each engine.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Mar 23, 2012.
