Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a renewal Air Title V permit for the continued operation of six 106 million Btu/hour natural gas fired boilers with No. 2 fuel oil as a back up fuel source. The boilers provide heating for the Empire State Plaza.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. The Draft Permit and Permit Review Report may be viewed and printed from the Department web site at: http://www.dec.ny.gov/chemical/32249.html.

DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Comments and requests for a public hearing should be in writing and addressed to the Department representative listed below. Project Description:

The New York State Department of Environmental Conservation (DEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY0005959), pursuant to 6 NYCRR Part 750-1.18, and 750-1.19, the Priority Ranking System known as New York State's Environmental Benefit Permit Strategy (EBPS). This modification will also serve to renew the SPDES permit, the term of which was extended under the State Administrative Procedures Act (SAPA).

Bethlehem Energy Center (BEC) is 750 MW combined cycle electric generating facility. Treatment consists of clarifier, Filter and demineralization (Reverse Osmosis) units.

The following changes to the permit are proposed: - Permit pages and conditions have been updated, renumbered and reordered, and reflect current permit language, DEC guidance, format and nomenclature. -Outfall 001: Limit for TSS has been added. Sampling frequency for pH has been changed from twice per month to daily. -Outfall 03A: Flow measuring frequency has been changed from twice per month to continuous. Per Permittee request, Total Chlorine Residual sample type has been changed from Automatic Sampler (Recorder) to grab sample. Sampling frequency for pH has been changed from twice per month to daily. - Short High Intensity Monitoring for pollutant parameters has been added in a schedule of compliance. - Additional Permit Requirements have been updated. - The list of authorized WTCs has been added. - Monitoring Locations, Water Flow Diagram, and Water Flow Balance chart has been updated.

Project Description:

Holcim (US) Inc. has decided to permanently close their cement making operations at their Catskill NY facility. The Department has reviewed a request by Holcim seeking authorization to dispose of the remaining raw meal slurry, currently stored on-site, in the currently active cement kiln dust landfill. The raw meal slurry is composed of approximately 20% water, 77% limestone and 3% bauxite. The raw materials were previously combined in a mill and ground into a fine slurry for the cement making operations.
