Project Description:

The applicant proposes to mine gravel on 9.43 acres of land on property owned by Jonathan Troyer and Randy Wakefield, both of which were previously permitted for mining activities. The mine consists of the 8.8 acres of land previously permitted for mining on the Troyer parcel and 0.63 acre of land which was the previous mining setback distance from the common property line between the Troyer and Wakefield properties, which will eliminate the creation of a ridge between the properties from mining activities. The haul road access to NYS Route 305 will be on the Wakefield property. Material will be screened with a pipe screen. The reclamation objective for the Troyer property is farmland and fields for animal grazing, and open field on the Wakefield property. The mine site is on the south side of St Rte 305, approximately 800 feet east of the intersection with South Road.

Project Description:

The Department has prepared a draft permit and has made a tentative determination to approve this application for renewal of the National Fuel Gas Supply Corporation Concord Facility Title V permit. It is a natural gas transmission facility consisting of five natural gas-fired stationary reciprocating internal combustion compressor engines, each rated at 2250 HP. The compressor engines are subject to the opacity limitations of 6 NYCRR Part 227-1.3(a). In addition, emission limitations have been added to the permit for volatile organic compounds (95 tons per rolling twelve month period), oxides of nitrogen (110 tons per rolling twelve month period) and carbon monoxide (185 tons per rolling twelve month period) as a result of Part 231 New Source Review analysis. The New Source Review analysis was required due to National Fuel's plan to install two pipeline jumpers beyond the existing Concord Compressor site in order to allow for the transmission of natural gas in both the northward and southward directions.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below.
