Project Description:

The Department has prepared a draft permit and has made a tentative determination to approve the application to modify the current Title V permit. The Title V permit modification incorporates the requirements of Part 249, Best Available Retrofit Technology (BART) into the Title V air permit for the Syracuse Energy Corporation facility. The facility is a coal fired 80 MW cogeneration power plant located in the Town of Geddes, Onondaga County, NY. The facility's coal fired boiler Unit 1 is subject to these requirements, and the facility has elected to shut down Unit 1 no later than January 1, 2014 in order to comply with Part 249.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. The New York State Department of Environmental Conservation (DEC) is pursuing a Department Initiated Modification (DIM) and renewal to the State Pollutant Discharge Elimination System (SPDES) Permit (NY0033901), pursuant to 6 NYCRR Part 750-1.18, and 750-1.19, the Priority Ranking System known as New York State's Environmental Benefit Permit Strategy (EBPS).

The CSX Transporation - Dewitt Yard operates a railroad transportation facility. Site stormwater runoff from the diked areas is combined with effluent from the oily water pretreatment system, before discharging to the receiving water known as an unnamed tributary to Butternut Creek, a class C water.

The following changes to the permit are proposed: - Name and address for company has been corrected from Consolidated Rail to CSX. - Outfall 002 has been removed from the permit as it no longer exists. -Technology based limits have been added for benzene, toluene, and xylene. - Updated treatment process diagram to reflect current operating conditions.

The Department has prepared a draft permit and has made a tentative determination to approve the application to modify the current Title V permit. The purpose of this permit modification is to incorporate requirements based on site-specific analyses performed as specified in the terms of 6 NYCRR Part 249 and 6 NYCRR Subpart 227-2. The terms of 6 NYCRR Part 249 require the implementation of Best Available Retrofit Technology (BART) for emissions of sulfur dioxide, oxides of nitrogen, and fine particulate matter (PM-10) at subject facilities. The terms of 6 NYCRR Subpart 227-2 require the implementation of Reasonably Available Control Technology (RACT) for emissions of oxides of nitrogen at subject facilities. The 6 NYCRR Part 249 and 6 NYCRR Subpart 227-2 permit conditions, based on site-specific analyses, contained in this permit modification are New York State enforceable on the date of permit issuance. The permit conditions mentioned above will become federally enforceable on the date when the requirements contained in these permit conditions are noticed in the Federal Register as revisions to New York State's Implementation Plan.
