Project Description:

The Department has prepared a Draft Permit and has made a tentative determination to approve the application for the renewal of Title V Permit. Motiva Enterprises LLC Property is a gasoline and distillates loading facility. Emission Unit T-TANKS includes ten (10) internal floating roof tanks; five (5) of these tanks store gasoline and five (5) tanks store ethanol or gasoline. Volatile organic compounds (VOC) emissions from this unit are limited to 29.57 tons per year. Emission Unit U-00001 includes 16 truck loading bays and a vapor recovery unit for the control of emissions from gasoline loading racks. VOC emissions from this unit are limited to 53.43 tons per year. Emission Units U-00012 and U-00013 include groundwater remediation/treatment systems for reducing VOCs and oil contents in groundwater and contact water. The facility shall not exceed annual throughputs of 585 million gallons of gasoline, 600 million gallons of total ethanol and gasoline, and 182 million gallons of distillate oil and biodiesel fuel during any twelve month rolling average.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a renewal of the existing Title V permit for this Resource Recovery facility. The facility operation consists of a waste to energy plant which produces electricity through the combustion of municipal solid waste (MSW). The facility is equipped with two O'Connor rotary combustors (MWC) with a nominal design capacity of 242.5 tons per day of MSW per unit.

Changes to the permit include removal of 40 CFR 52.21(j)(2)(subpart A) emission limits for SO2, NOx, CO, lead and particulate matter in accordance with established EPA policy for streamlining prior NSR permit terms that are obsolete, extraneous, environmentally insignificant, or otherwise not required. Removal of subpart Db requirements or replacement with subpart BBBB equivalent requirements and removal of the combustion zone temperature monitoring requirements.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

The Department has made a tentative determination to approve this application for a department initiated modification of a permit for an existing discharge of 3500 gallons per day of untreated cooling wastewater to groundwater at the applicant's facility located at 10 Vitamin Drive, Bayport, New York. Information recently submitted to the Department indicates the need to modify the permit in order to increase the allowable flow, remove Antimony from the parameters to be sampled, and change the discharge class from an 01 to an 04.
