Project Description:

The applicant proposes a 3.6 acre expansion to the currently permitted life-of-mine limits (LOML). The modification will increase the currently permitted acreage from 4.7 to 8.3 acres out of 38.15 acres owned by the applicant at this location. The modification also includes the addition of an impact crusher and small wash plant for the processing of sand and gravel materials and a new haul road connection to NYS Route 219. Upon reclamation of the site, the currently permitted 1.3 acre, 20 foot deep pond will be enlarged to 5 acres with a maximum depth of 50 feet; approximately 3 acres of meadow will be created; and the haul road connection to NYS Route 219 will remain for the existing commercial business and as an entrance to the mining property.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: NYS Department of Environmental Conservation

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Mar 09, 2012.

Project Description:

The Department has drafted a SPDES permit and made a tentative determination to approve this application for two treated wastewater discharges from the Orchard Park school district offices and transportation facility located at 2240 Southwestern Boulevard. One discharge is up to 2800 gallons per day of sanitary wastewater after treatment by a septic tank/sand filter system to groundwater. The second discharge is up to 100 gallons per day from an oil and water separator/grit chamber treatment system and on-site detention basin that outfalls to a Town ditch and eventually to Cazenovia Creek, a class B waterbody. The Department is seeking public comment prior to making a final decision on permit issuance.

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.
