The access road associated with this development will permanently impact (fill) approximately 0.015 acres (133 linear feet) of a federally regulated tributary to Mill Creek. A stormwater pollution prevention plan has been prepared and approved by the Town of Webster. The U.S. Army Corps expects to authorize the project (2011-01387) under Nationwide Permit No. 39.

Applicant proposes to stabilize a bank by installing approximately 175 feet of rock riprap. The rock riprap will replace a 75-foot section of existing wood breakwall and the remaining 100-foot section will be new. All of the rock riprap will be generally above mean high water level (MHWL). A dock and stairway are also proposed, requiring temporary placement of swamp pads consisting of oak boards below MHWL to allow for equipment access to facilitate placement of the dock This project is located within a Coastal Erosion Hazard Area.
