Meeting Notice

The City of New York Department of Sanitation Announces Annual Consent Order Meeting Regarding Fresh Kills Landfill

The City of New York Department of Sanitation (DSNY) will hold its annual public meeting regarding the Fresh Kills Landfill on Wednesday, February 15, 2012 beginning at 7:00 p.m. at Staten Island Borough Hall, first floor conference room (Room 122), located at 10 Richmond Terrace in Staten Island, NY 10301. Please use the Stuyvesant Place entrance. The meeting will provide information on the following:

  • Fresh Kills Landfill Consent Order Milestones
  • An overview of landfill closure and post-closure plans

Members of the public will have an opportunity to speak, and representatives of DSNY will be available to answer questions.

Notice of Legislative Public Hearing

Project Description and Location:

Applicant Harold Donald has applied to the New York State Department of Environmental Conservation (NYS DEC) for a Tidal Wetlands Permit to construct three one-family detached houses, each three stories high, including two-car garages, associated curbs, sidewalks, street improvements, driveways, patios and utilities. The application includes a request for a variance from the 30 foot minimum setback requirement pursuant to the Tidal Wetland Land Use Regulations (6 NYCRR 611.6 and 661.11). The project site is located at Fairlawn Avenue between Mansion Avenue and Great Kills Harbor, Staten Island, Block 5202, Lot 173. As mitigation for the project, the applicant proposes to create a 10 foot vegetative buffer consisting of native species along the boundary of the development (0.13 acres), enhancements to the finger wetland area that runs parallel to Mansion Avenue (0.06 acres), and a deed restriction prohibiting development of the mitigation areas, tidal wetlands vegetation and open water (total of 1.6 acres). The total project area as described in the permit application is 2.132 acres and the area of proposed development is 0.53 acres.

SEQRA Status: Department staff has determined that this is an unlisted action and issued a negative declaration on July 7, 2011 based upon its determination that there will be no significant adverse environmental impacts. 6 NYCRR 617.2(y).

Notice of Complete Application: Staff issued a notice of complete application on July 8, 2011.

Coastal Assessment: Applicant completed a New York State Department of State Coastal Management Program Federal Consistency Assessment Form (CAF) dated November 13, 2008, indicating that the proposed activity is consistent with New York State's Coastal Management Plan (CMP). In addition, applicant completed a New York City Waterfront Revitalization Program (WRP) CAF also dated November 13, 2008, certifying that the proposed development is consistent with NYC's WRP.

NYS DEC Staff's Position: By letter dated September 27, 2011, Assistant Regional Attorney Udo Drescher informed applicant of NYS DEC staff's decision to request a public hearing based upon the public comments received opposing the project. Following the submission of that hearing request, the applicant revised the proposed project by modifying the layout of the residential units, eliminating previously proposed patios, and increasing the setback between the proposed structures and the tidal wetland. Based upon a revised site plan presented to the NYS DEC on December 14, 2011, NYS DEC staff has tentatively decided that it is appropriate to issue a Tidal Wetlands Permit and a variance to the applicant.

Public Legislative Hearing:

In accordance with the provisions of Parts 621 and 661 of 6 NYCRR, a legislative hearing will be held before Administrative Law Judge (ALJ) Helene G. Goldberger to receive unsworn statements from the public on the permit application on Tuesday February 21, 2012 at I.S. 24 Myra Barnes Intermediate School located at 225 Cleveland Avenue, Staten Island, New York at 7:00 p.m.

All persons, organizations, corporations or government agencies that may be affected by the project are invited to attend the hearing session to submit oral or written comments. Written comments may be sent to Harold Dickey, NYS DEC - Division of Environmental Permits, 47-40 21st Street, Long Island City, NY 11101-5407 until March 9, 2012. It is not necessary to file a written request in advance to speak at the legislative hearing.

The hearing location is reasonably accessible to persons with mobility impairments. Interpreter services shall be made available to deaf persons, at no charge, upon written request to the ALJ at least 10 business days before the hearing.
