Project Description:

The applicant, New York Power Authority, proposes to create ecological enhancement and shoreline protection features along the shoreline of Motor Island in the Niagara River. Motor Island is managed by the New York State Department of Environmental Conservation as a wildlife management area. The proposal includes the establishment of a variety of habitat types through the planting of riparian, emergent and upland vegetation; creation of wetland, sloped shoreline, beach and pool habitats; and the removal of certain man-made structures and invasive species and the installation of low profile stone berms to protect against erosion.

Project Description:

The Department of Environmental Conservation (DEC) has prepared a draft permit and has made a tentative determination to issue a renewal to State Pollutant Discharge Elimination Systems (SPDES) permit (NY#0027766) for the discharge of 2.75 mgd of treated surface wastewater to the Niagara River, a Class A-Special water.

Treatment at the facility of a plant influent screen, primary clarifiers, aeration tanks with diffused air, final clarifiers and a chlorine contact tank. Ferric chloride is used for phosphate removal and is added at the headworks of the plant. Sodium hypochlorite is used for disinfection which is added before the contact tank. Grit and sludge is handled by Modern Disposal Services.

DEC proposes to incorporate the following modifications to this permit: -Contact name information was updated. -Special Conditions for Outfalls 01A and 002 were deleted from page 2 and moved to pages 5 and 6. -Sanitary Sewer Overflows Best Management Practices replaced Combined Sewer Overflows Best Management Practices. - Whole Effluent Toxicity Test requirements were added. -Stormwater Pollution Prevention Plan requirement was added. -Discharge Notification Page and Monitoring Diagrams Page was updated.

Project Description:

The Department has prepared a draft permit modification for the facility which is a producer of crushed limestone and asphalt paving products. The modification reflects the removal of the drum asphalt plant and a change in the production cap for the batch asphalt plant. The facility will accept production limits for the batch plant to maintain potential emissions below the major source thresholds for volatile organic compounds (VOC), sulfur dioxide, nitrogen oxides (NOx), carbon monoxide, particulate matter and various hazardous air pollutants. Production of asphalt will be limited to 450,000 tons per year during each rolling 12 month period in order for actual emissions from all emision sources, including fugitives, to remain less than the major source thresholds. This permit contains facility-wide federally enforceable emission limits to establish minor source status for 6NYCRR, Part 231-2-Non-Attainment New Source Review; 6NYCRR, Part 212.10-Resonably Available Control Technology for VOC and NOx; and 6NYCRR, Part 201-6- Title V Permits. The Department is seeking comments on the proposed regulated activity prior to making a final decision on permit issuance.
