Negative Declaration

Rensselaer County - The East Greenbush Town Board, as lead agency, has determined that the proposed Witbeck Planned Development District will not have a significant adverse environmental impact. The action involves the Witbeck Planned Development District (PDD) which is proposed as a 100 unit residential development situated on 40.99 ± acres. The Witbeck PDD final approved subdivision/site plan approval will consist of a maximum 100 residential units broken down in the following proportions.

1. The project shall have a maximum of 60%, four (4) unit town homes and a minimum of 20%, four (4) unit town homes.
2. There shall be a maximum of 60%, two (2) unit twin home buildings and a minimum of 20%, two (2) unit twin home buildings.
3. There shall be a maximum of 60% single family residential units and a minimum of 20%, single family residential units.
4. There shall be one 2,000 square foot (minimum) community center together with adjunct parking and facilities.

The project is located on Phillips Road in the Town of East Greenbush, New York.

Rensselaer County - The New York State Department of Environmental Conservation (NYS DEC), as lead agency, has determined that the proposed Polaro Mine Modification will not have a significant adverse environmental impact. The action involves the addition of 4.4 acres to an existing 4.7 acre sand and gravel mine. The project is located on State Route 351 (Round Top Road) in the Town of Poestenkill, New York.

Schenectady County - The Town Board of the Town of Niskayuna, as lead agency, has determined that the proposed Lands of Wagner, Balltown Road will not have a significant adverse environmental impact. The action involves an amendment to a previously approved zone change that restricted apartment construction in the R-3: High Density Residential Zoning District. This amendment would lift the restriction and allow apartment to be constructed. The project is located on Balltown Road in the Town of Niskayuna, New York.

Notice of Acceptance of Draft EIS and Public Hearing

Rensselaer County - The New York State Department of Environmental Conservation (NYS DEC), as lead agency, has accepted a Draft Environmental Impact Statement on the proposed S.A. Dunn Sand and Gravel C&D Site. A public hearing on the Draft EIS will be held on February 6, 2012 at 6:00 p.m. at the Rensselaer City Hall, 62 Washington Street, Rensselaer, NY. Comments on the Draft EIS will be received postmarked through February 17, 2012. The Draft EIS is available for review at the Rensselaer City Hall, 62 Washington Street, Rensselaer; Rensselaer Public Library, 676 East Street, Rensselaer; North Greenbush Town Hall, 2 Douglas Street, Wynantskill, and North Greenbush Public Library, 141 Main Avenue, Wynantskill, or the NYS DEC - Region 4 Office. The action involves the conversion of an existing 57.9 acre sand and gravel mine to a 68.54 construction and demolition (C&D) disposal area. The site is located on the east side of Partition Street Extension in the City of Rensselaer/Town of North Greenbush, Rensselaer County.
