Project Description:

Applicant proposes to install a new approximately 700-foot promenade and approximately 524-foot concrete breakwall below mean high water level elevation of the NYS Barge Canal. This project is a preliminary step in the overall development of this approximately 4-acre site which will eventually also include private development of about 2 acres for 58 residential condominiums and restaurant. The breakwall and associated excavation portion of the project require an Article 15 Protection of Waters permit from NYSDEC. Approximately 1,500 cubic yards of fill will be excavated, with some of the material remaining on site as backfill to the breakwall and a portion being disposed of at an approved upland location. The overall amount of fill below mean high water level associated with the new breakwall and backfill is approximately 0.7 acres.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was performed.

SEQR Lead Agency: Fairport Village Planning Board

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Jan 26, 2012.

Project Description:

The Department has made a tentative determination to issue a permit modification to the existing SPDES permit for the Corning Inc. Sullivan Park Industrial Research and Development Laboratory, located on One Science Center Drive, which authorizes the discharge of chiller blowdown, noncontact cooling water and stormwater to the Cohocton River and a Tributary of the Tioga River. The modifications, resulting from the construction of new electronically powered chillers, include: the addition of use of Nalco CL-50 and associated phosphorous monitoring; removal of Outfall 010; removal of non-contact cooling water and temperature limits from outfall 007, as well as reduced monitoring for this outfall; and updates to the Best Management Practices and Discharge Notification Act requirements. As a tentative determination, the Department seeks comments prior to making a final decision. The file is available at NYSDEC Region 8 for review and comment.
