Project Description:

The project involves the subdivision of land into 2 single-family lots with 1 single-family home to be built on each lot. Lot 5A off of Denison Road is approximately 1.85 acres and Lot 17 off of Tulip Tree Lane is approximately 15.53 acres. The lots will have private water wells and will be served by a public sewer.

The development of the 2 lots will result in impacts to approximately 0.049 acre of federally regulated wetlands and 18 linear feet of intermittent stream.

The project site is located east of Denison Road and south of Oak Tree Lane in the Town of Colonie.

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Project Description:

The Department has prepared a draft permit and has made a tentative determination to modify the Air State Facility Permit for the Wastequip Manufacturing Company LLC facility located at 1079 US Route 20, Town of New Lebanon, County of Columbia. The facility manufactures steel refuse bins. The facility forms light gauge steel into walls/floors/channels which are welded (assembled) using metal inert gas equipment. Larger bins utilize pre shaped channel for floors and top rails. Assembled bins are coated w/ primer and w/ enamel top coatings. The facility is subject to 6 NYCRR Part 228 and is capping from 6 NYCRR Part 201-6, Title 5 by limiting emissions of volatile organic compounds (VOC).

Persons wishing to inspect the subject Air State Facility files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the Department representative noted below. The Draft Permit may also be viewed and printed at http://www.dec.ny.gov/dardata/boss/afs/draft_asf.html.

Comments and requests for a public hearing should be made in writing and addressed to the Department representative listed below. The Department will evaluate the application and any comments received to determine if a public hearing is necessary. A copy of the Department's permit hearing procedures is available upon request or can be found at: http://www.dec.ny.gov/regulations/2398.html.
