Negative Declaration

Cayuga County - The Town of Brutus Town Board, as lead agency, has determined that the proposed Approved Local Law #2 of 2011: Changes to Special Development District will not have a significant adverse environmental impact. The action involves the adoption of Local Law #2 which listed changes made to the Special Development Zoning District as identified by the Planning Board, Code Enforcement Officer and planning policy review. These updated changes were reflected in the amended Town of Brutus Zoning Map. It was determined that the Town of Brutus Special Development District Regulations had become outdated and were no longer assisting in the appropriate development of the Town of Brutus. The project is located NYS Route 31, east and west of the Village of Weedsport and NYS Route 5 within the Town of Brutus, New York.

Tioga County - The New York State Department of Environmental Conservation (NYS DEC), as lead agency, has determined that the proposed Porter's Concrete Service, Inc. - Hidden Lake Mine will not have a significant adverse environmental impact. The action involves a proposal by the applicant to operate a sand and gravel mine on 11.80 acres within a 48.23 acre parcel of land owned by Eli and Patricia E. Vanderpool and their company, Hidden Lake Development Corporation. Reclamation will be for the purpose of deepening and expanding the current shallow ponds on site for private recreational use of the landowners. The project is located at 177 Old Barton Road, east of the Conrail railroad tracks and west of Old Barton Road, approximately ¼ mile east of NYS Route 17 in the Town of Barton, New York.
