Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue an Air State Facility permit to supplement the applicant's current Title V permit, initially issued on April 13, 2007. The Samuel A. Carlson Generating Station is a municipal electric power generation plant. This permit includes shutting down boiler 11 on January 1, 2012, shutting down boiler 12 by January 1, 2014, updating emission unit and process descriptions for the shutdowns, and modifies particulate and Compliance Assurance Monitoring (CAM) permit conditions that apply to these two boilers. The Title V permit requirements for the other emission sources that are not affected by this permit remain in full force and effect. The conditions in this permit will be incorporated into the Title V permit within one year.

Boiler 12 is subject to the Best Available Retrofit Technology rule (BART), 6 NYCRR Part 249. The facility has decided to permanently shut down boiler 12 on or before January 1, 2014 in order to be exempted from the BART requirements for that unit. Accordingly, by shutting down boiler 12 by January 1, 2014, the facility will not need to install BART or meet the NOx Reasonably Available Control Requirements, 6 NYCRR Part 227-2, which become effective on July 1, 2014. Pursuant to 6 NYCRR Part 249, each BART determination, such as the BART determination set forth in this Notice, will be submitted to the USEPA for approval as a revision to the State Implementation Plan.

Boiler 11 is formally being shutdown on January 1, 2012 with this permit because it will not be used again.

Availability of Application Documents:

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Jan 27, 2012.
