Project Description:

The Department has prepared a draft Title V permit and has made a tentative determination to approve the application for a Title IV Acid Rain permit for this facility. This facility consists of two multiple fuel-fired boilers rated at 5,546 MMBtu and 5,374 MMBtu. This facility also has a 615 KW emergency generator, several storage tanks for fuels, lubricating oils, and chemicals. Other sources include a boiler water treatment plant and a wastewater treatment plant. The facility is a major source for Oxides of Nitrogen, Sulfur Dioxide and Particulates/PM10/PM2.5.

New Best Available Retrofit Technology (BART 6NYCRR Part 249) requirements are effective January 1, 2014. NOx: Lowering the existing emission to 0.12 lb/MMBtu (24-hr avg. during ozone season, 30-day avg. during non-ozone season).

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the Draft Permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. The applicant proposes to renew the existing permit for the discharge of 11,000 gpd of treated sanitary wastewater to North Branch of Minisceonga Creek, a class C(t) stream from the Willow Grove Trailer Park Sewage Treatment Plant located at 451 Cove Hollow Road, Stony Point, New York. No changes are being made to the treatment or discharge from the facility.

The Department has made a tentative determination to renew the permit for the State Pollutant Discharge Elimination System permit under Article 17 of the Environmental Conservation law. This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance.

Par Pharmaceutical, Inc. is a manufacturer as well as a research and development facility of pharmaceutical products. The facility is located in Chestnut Ridge, Rockland County, New York. Potential emissions of Volatile Organic Compounds exceed major source thresholds subjecting the facility to Title V permitting. The facility emissions of individual and total Hazardous Air Pollutants (HAPs) are limited below major source thresholds. The facility is subject to monitoring and record keeping requirement under 6NYCRR Parts 201 and 212. The Standard Industrial Code (SIC) is 2834 - Pharmaceutical Preparations.

Installation of a new Glatt GPCG-60 Coater/Granulator/Dryer with associated fume hood and dust collector. The new equipment is subject to the existing 6NYCRR Part 212 particulate and Volatile Organic Compound control requirements. Operations are limited to 100 production batches per year to avoid New Source Review applicability.

Project Description:

The Department has made a tentative determination to approve this application for modification of the existing SPDES permit NY 002 5925 for the discharge of an admixture of treated sanitary waste and industrial waste, from agricultural slaughter and processing and printing facilities, to the Shawangunk Kill, NYS Waters Index # H-139-13-19, Class B, and industrial waste in the form of water treatment plant filter backwash to a private reservoir on site. The site has shifted to a greater residential population and a reduction in agricultural operations. Upgrades to the existing plant are proposed to address these changes in the waste stream and to increase the efficiency and effectiveness of the operation. The proposed modifications to the effluent limits reflect the current standards and the reduction in industrial waste production.

A draft SPDES permit with DEC proposed effluent limits and monitoring requirements is available for review at the DEC Region 3 headquarters in New Paltz. The permittee will be required to maintain records and report data to verify compliance with the SPDES permit conditions and discharge limits.

No disturbance to the bed or banks of the Shawangunk Kill is proposed and as rehabilitation without expansion, this is not subject to regulation under 6 NYCRR Part 666, Wild, Scenic, and Recreational Rivers.
