ENB - Region 9 Notices 12/28/2011
Cattaraugus County - The Town of Perrysburg, as lead agency, has determined that the proposed Town of Perrysburg Central Water District will not have a significant adverse environmental impact. In July 2005 the Town Board of Perrysburg issued a negative declaration for this project in its original scope. Since the issuance of the Negative Declaration in July 2005 the project scope has changed and this Amended Negative Declaration includes those changes. The proposed rehabilitation of the Mosher Road treatment plant and pumping station could not effectively be completed while still complying with New York State Health Department standards. A decision was made to abandon this water treatment plant and to simply site a pump station on the site. The project will now consist of construction of a new water treatment plant. This water treatment plant is to be sited on the 10 acre parcel that contains the two existing New York State Office of Mental Retardation and Developmental Disabilities (NYS OMRDD) storage reservoirs. This 10 acre site was a part of the original environmental review conducted in 2005.
The project is located westerly off Peck Hill Road approximately 1 mile south of Route 39 in the Town of Perrysburg, New York.

Erie County - The Town of Cheektowaga, as lead agency, has determined that the proposed 2480-2550 Walden Avenue - Commercial Rezoning will not have a significant adverse environmental impact. The action involves the rezoning of approximately 17.43 acres of developed land currently zoned M1- Light Manufacturing to CM- General Commercial. The existing parcel is improved with a 122,500 square foot retail flea market building, a 30,000 square foot retail/office building, a 32,000 square foot retail/office building and a 3,500 square foot retail building. Such existing land uses are lawful non conforming uses within the M1- Light Manufacturing zoning district. All of the existing buildings with the exception of the 3,500 square foot retail building will be demolished for the removal of a total of 184,500 square foot of building area, and the construction of a 185,000 square foot retail building. The Town of Cheektowaga reserves its right to segment the rezoning action from any future approval of a site plan for the proposed retail building until such time that the land owner identifies a proposed tenant/building user. At such future time, the Town of Cheektowaga will conduct a separate determination of significance pursuant to SEQR when a detailed site plan is submitted for such tenant/building user. The project is located at 2480 and part of 2490-2550 Walden Avenue in the Town of Cheektowaga, New York.

Notice of Acceptance of Final GEIS
Niagara County - The Town of Niagara, as lead agency, has accepted a Final Generic Environmental Impact Statement on the proposed Niagara Airport Commercial Park. The Final GEIS is available from the Town of Niagara Town Hall, 7105 Lockport Road, Niagara Falls, NY 14305 and on line at: http://www.townofniagara.com/.
The action involves the Conceptual Site Plan approval for the proposed Niagara Airport Commercial Park. Conceptual Site Plan approval is sought from the Town of Niagara in order to complete the application for Shovel Ready Certification for development as a "High Technology Manufacturing" site under the Build Now - NY program. The Town of Niagara is the Lead Agency for the Proposed Action.
The approximately 216 acre project site is owned SGL Equities, LLC and is primarily comprised of agricultural fields and vacant land.
A Conceptual Site Plan has been developed for the purposes of assessing impacts and establishing thresholds for development under the generic environmental impact statement. Development consists of a total build out of 850,000 square feet of high-tech manufacturing space. During the first phase, a 250,000 square foot building would be constructed, with the remaining 600,000 square feet at full build-out. For the purposes of site planning and for environmental assessment, the conceptual layout considers five buildings of 50,000 square feet, 100,000 square feet, 200,000 square feet, 250,000 square feet and 250,000 square feet.
The project is generally bounded by Haseley Drive on the west, Packard Road/Lockport Road on the north, Tuscarora Road on the east and the Niagara Falls Air Reserve Station and Niagara Falls International Airport on the east and south in the Town of Niagara, New York.
