Project involves construction of a new fixed dock facility and boat launch along the north shore of the Erie Canal to provide waterfront access. Project consists of a 215'L X 10'H retaining wall of Redi-rock, a 32'W boat launch ramp will extend approximately 20' into the water, and there will be 8' W docking for 5 boats.

Temporary cofferdams and turbidity curtains will be installed to control sedimentation and pollution of the water. The construction area will be seeded and mulched upon completion of the project.

Project Description:

This Department has received a request to modify a permit and has drafted pursuant to Article 19 (Air Pollution Control) of the Environmental Conservation Law, an Air State Facility Permit, at the Buckeye Marcy Terminal at the facility located at 9570 Riverside Drive, Marcy , NY 13403; Oneida County.

The Department has made a tentative determination to approve the application for modification to the State Facility Permit. This modification includes a request to combine two facilities located next door to each other, the Marcy West Terminal-DEC Facility ID #6-3044-00039 and the Buckeye Marcy Terminal-DEC Facility ID #6-3044-00045, both owned by Buckeye Terminals LLC. The facility will retain DEC ID #6-3044-00039 but will change the name from Marcy West Terminal to Buckeye Marcy Terminal. Both facilities are gasoline and petroleum bulk storage terminals. This modification also incorporates the new EPA requirement 40 CFR 63 Subpart BBBBBB. The State Facility Permit allows the operations of emission units U-00001, and U-00002, which includes the vertical storage tanks for gasoline, and the gasoline loading rack with control. The permit also allows for the installation of a new control equipment for the loading rack and using the current control unit as an emergency backup. The facility remains capped out of Title V Permitting and Federal Requirement 40 CFR 63, Subpart R by tracking and restricting its emissions of Hazardous Air Pollutants below individual emissions of 10 tons per year and cumulative emissions of 25 tons, and Volatile Organic Compounds (VOC'S) emissions below 50 tons per year. This permit includes Federally enforceable conditions that have been modified for an increase in the facility's process monitored limitations for the CAPS due to the instillation of the new control equipment.

In accordance with 6NYCRR Part 621.5(d)(9) and 201 6.4(c), the Administrator of the Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201. After the public comment period , the USEPA will be provided a proposed permit and will have an additional 45 day period for review. If USEPA does not raise an objection, the Department will issue the permit.

The draft permit with all conditions is available for review in the Region 6 NYSDEC sub-office in Utica, NY.

Marcy West Terminal (formerly known as Amerada Hess Corporation) and Marcy Terminal (formerly known as Agway Petroleum Corporation) are two petroleum bulk storage and transfer stations located adjacent to each other in Marcy, New York. The Marcy West Terminal is authorized to discharge wastewater under State Pollutant Discharge Elimination System (SPDES) Permit NY-0218367 and the Marcy Terminal is authorized to discharge wastewater under SPDES Permit NY- 0235768.

Buckeye Terminals, LLC, currently owns both facilities. Recent modifications were made such that the two facilities are now operated as one facility. Buckeye Terminals, LLC, submitted a completed application requesting the two individual SPDES permits be combined into one permit. New York State Department of Environmental Conservation has made a tentative determination to approve this application under Article 17 of Environmental Conservation Law. The facility name will be Buckeye Marcy Terminal and SPDES Permit NY-0218367 will be retained. SPDES Permit NY- 0235768 will be discontinued.

The Buckeye Marcy Terminal is a petroleum receipt, storage and distribution facility. Product is transferred to the facility's bulk storage tank farm through a pipeline. Final distribution of product is made is conducted at the facility's vehicle loading rack. Ethanol is offloaded at the vehicle loading rack and is stored at the facility prior to mixing with the product during final distribution.

Discharge of stormwater from the west secondary containment area and transfer unit are made through outfall 001 to an unnamed tributary of the Barge Canal, a Class C fresh surface water.

Discharge of stormwater from the east secondary containment area and transfer unit are made through outfall 002 to Tributary H-240-216, also a Class C fresh surface water.

Stormwater runoff is weather-dependent, and the flow design based on pumping capacity is 18,000 gallons/hour for outfall 001 and 21,000 gallons/hour for outfall 002. Wastewater sources include stormwater runoff from the secondary containment areas, stormwater runoff from the vehicle loading racks and hydrostatic test water. Runoff from each loading rack is treated by an oil-water separater followed by carbon adsorption.

The following changes to the permit are proposed: Additional monitoring requirements and effluent limits for pH, Flow, Settleable Solids, Total Suspended Solids, Ethanol and Naphthalene have been added. Discharge of tank water bottoms is now prohibited. Discharge of vehicle wash waters using detergents or other chemicals is now prohibited, therefore, monitoring and effluent limits for Foaming Agents, Cadmium, Zinc and action limits for Arsenic, Iron, and Lead is no longer required. Industrial Best Management Practices requirements have been updated. Monitoring page with flow diagram has been revised. Discharge Notification requirements have been updated. Permit pages have been revised to reflect current NYSDEC format and nomenclature. Permittee contact information has been updated.

This tentative determination indicates that the discharge regulated under this statute satisfies regulatory standards for permit issuance, based on the information available to the Department at this time. As a tentative determination, the Department seeks comments on the regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify department approval for, or endorsement of, the activity for which a permit is sought for the overall project.

Project Description:

The applicant proposes to develop and operate an 11.7 acre waste rock mine within a 1,980 acre parcel off of NYS Route 3. The project site is on property owned by Benson Mines, Inc. and lies 700 feet northerly of NYS Route 3, with the haulroad entrance 2,250 feet westerly of Newton Falls Road. The mine will process granitic to granitic hornblende gneiss waste rock that was blasted and stockpiled during the operation of the Benson Mines Iron Ore operation from the 1940's through the mid 1970's. Mining is not proposed to take place below the local water table. Excavation will be done by mechanical equipment, standard for rock mining operations and for removal of material from a stockpile face. Mining is proposed to remove approximately 550,000 cubic yards waste rock over the operational life of the mine. Material will generally be excavated from the stockpiles, crushed, screened and stockpiled for future use. Final reclamation will restore the site to a wooded area. Mine slopes will be graded and stabilized and planted with red or white pines. The reviewed life-of-mine area is 11.7 (LOM) acres.
