This was previously incorrectly noticed in the July 20, 2011 ENB as a Type II reissuance, however, it is an Unlisted Action for issuance of a new permit for an existing facility.

The Department has made a tentative determination to issue a SPDES permit to discharge a maximum volume of 40,000 gallons per day of treated sanitary wastewater from outfall 001 to a ditch trib. to Ellis Pond (Water Index No. CT-15-1-P113, Class A, and 3,900 gpd of treated sanitary wastewater from outfall M to groundwater through the septic tanks and leach field from the four buildings onsite. The submission of Discharge Monitoring Report (DMR) and the monthly "Wastewater Facility Operation Report" is required for the surface discharge facility whenever the facility is open. A draft SPDES permit (SPDES No. NY0280356) and Fact Sheet are available for review at the NYSDEC Region 3 office.

Project Description:

The Department has prepared a draft permit and has made a tentative determination to approve the application for a Title IV Acid Rain permit for this project. In addition, The Cricket Valley Energy Center (CVE) is renoticing their draft Air State Facility permit to construct. CVE is conducting the re-notice based on revisions to the permit which include the addition of new conditions and the revision of existing conditions. The revisions to the existing conditions consist of the addition of enhanced monitoring and compliance requirements (record keeping and reporting). The newly added conditions consist of a 191.9 ton per year (tpy) particulate matter (PM) facility limit, a 191.9 tpy PM10 facility limit, a 191.9 tpy PM2.5 facility limit, a 569.9 tpy carbon monoxide facility limit, a 46.9 tpy sulfur dioxide facility limit, a 19.7 tpy hydrogen sulfide facility limit, a 3,597,766 tpy carbon dioxide equivalent (CO2e) limit on the facility, a 3,576,943 tpy CO2e limit on the combustion turbines, a 7,605 Btu per kilowatt hour efficiency standard on the combustion turbines, start-up and shutdown conditions on the combustion turbines, and the inclusion of emission reduction credit (ERC) conditions for oxides of nitrogen (NOx) and volatile organic compounds (VOC). As per the requirements of 6 NYCRR Subpart 231-5, the facility is subject to nonattainment new source review (NNSR) for NOx and VOC. Based on the applicability of NNSR, the facility has purchased 322.11 tpy of NOx ERCs and 136 tpy of VOC ERCs to comply with the rule. The sources of these ERCs are as follows:

Project Description:

The project involves the release of Triploid Grass Carp to control the presence of aquatic nuisance vegetation, predominantly Eurasian watermilfoil and Curly-leaf pondweed within Kirk Lake, a 124 acre freshwater lake containing a small part of NYS Freshwater Wetland OL-18 (Class 2). In addition, to prevent downstream emigration of the stocked Triploid Grass Carp, an emigration control device (fish screen) will be installed 220 ft downstream of the dam, in the rock-lined channel of a tributary of the Muscoot River, Class A.
