Project Description:

The Department of Environmental Conservation has made a tentative determination to issue a modification to the existing SPDES permit issued to the City of Corning for the discharge of treated effluent from outfall 001 to the Chemung River. The permit modification includes elimination of the iron limit because the facility no longer takes in leachate for treatment. However iron will be monitored, and an Action Level will be included, due to the use of Ferric Chloride for Phosphorus removal. The permit and application are available for review and comment at the NYSDEC Region 8 office.

Availability of Application Documents:

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

This project is subject to the Department's Environmental Justice Policy and an enhanced public participation plan has been prepared and accepted as a component of application completeness. As part of the plan, a document repository has been established near the project area that contains application and project related materials. Information on the repository location and other outreach components of the plan is available from the identified DEC contact.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Project Description:

The Department has received an application from the Town of Woodhull for a 3.3 acre expansion of an existing sand and gravel mine on Herrington Road. The current permit authorizes operation in a 2.3 acre life of mine area. The expansion proposed will increase the life of mine area to 5.6 acres.

Excavation is proposed to remove approximately 160,000 cubic yards of sand and gravel from the site. Material will continue to be used for Town Highway Department operations. The expansion will continue current operations at the site over a larger area.

Mining is not proposed below the local water table. A berm and mine floor grading towards the face of excavation will retain storm water runoff within the mined area. No off site discharge of storm water runoff will be permitted. There are no NY State regulated streams or freshwater wetlands within the mine or the 3.3 acre expansion area.

No change has been proposed in hours of operation. Final reclamation to open vegetated land is proposed, and will include the placement of stockpiled and imported topsoil and seeding with an approved mixture.

The complete application is available for review at the Region 8 NYSDEC office, and a copy of the application materials has been sent to the Town of Woodhull.

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: NYS Department of Environmental Conservation

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
