The Department has made a tentative determination to re-issue the permit and a Draft Permit is on file at the DEC office in New Paltz.

Project Description:

The applicant proposes the subdivision of the property at 83 Brevoort Lane to create two lots for construction of one new single-family home and the conversion of an isolated, unregulated, brackish wetland at 85 Brevoort Lane to a tidal rain garden and stormwater treatment structure connected to the Long Island Sound. The proposal includes improvements to the existing driveway at #83 in the tidal wetland adjacent area and the coastal erosion hazard area and at #85 the excavation and planting at within the adjacent area for the construction of the rain garden and installation of a culvert within the coastal erosion hazard area, wetland adjacent area, and tidal wetland to provide connection between the rain garden and the Long Island Sound. No disturbance of vegetated tidal wetland is proposed.

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Project Description:

The applicant proposes the renewal and modification of the existing State Pollutant Discharge Elimination System (SPDES) permit, NY0109584, DEC ID number 3-5538-00066/00001, for the North Castle Sewer District No. 2 Wastewater Treatment Plant. The application proposes the increase in the 30 day average flow from 0.45 million gallons per day to 0.50 million gallons per day to provide adequate capacity for existing and future development. The facility is located at Bedford Road in Armonk, Westchester County.

The Department has made a tentative determination to issue the renewal and modification for a State Pollutant Discharge Elimination System permit under Article 17 of the Environmental Conservation law. This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of the activity for which a permit is sought or for the overall proposed project.

A draft permit is available for inspection and comment at the DEC Region 3 Office. Refer to this application by application number listed above and SPDES number, NY0109584.
