Extension of Public Comment Period

Revised Draft Supplemental Generic Environmental Impact Statement on the Oil, Gas and Solution Mining Regulatory Program (revised draft SGEIS); Proposed State Pollutant Discharge Elimination Permit (SPDES) General Permit for Stormwater Discharges; and Proposed Regulations (Addition of 6 NYCRR Parts 52, 560 and 750-3 and Revisions to 6 NYCRR Parts 190, 550-556 and 750-1).

The New York State Department of Environmental Conservation (NYS DEC) is extending the public comment period for the Revised Draft SGEIS, the proposed SPDES General Permit for Stormwater Discharges from High-Volume Hydraulic Fracturing; and proposed regulations that will add or revise 6 NYCRR Parts 52, 190, 550-556, 750-1 and 750-3. The comment period will close at 5:00 p.m., January 11, 2012. The Revised Draft SGEIS was made available for public comment on September 7, 2011. The proposed SPDES General Permit for Stormwater Discharges and proposed regulations were made available for public comment in the September 28, 2011 issue of the State Register and ENB. Public hearings were held in November 2011.

Comments: The public comment period will be open until 5:00 p.m., January 11, 2012. NYS DEC is offering two ways in which to submit comments:

Clean Water State Revolving Fund (CWSRF) for Water Pollution Control and Drinking Water State Revolving Fund (DWSRF)
Smart Growth Review of Projects - Public Input from Affected Communities

The FFY 2012 Intended Use Plans (IUPs) for the CWSRF and DWSRF have recently been finalized. The IUPs contain lists of projects that may receive financial assistance between October 1, 2011 and September 30, 2012. In accordance with the State Smart Growth Public Infrastructure Policy Act, New York State Environmental Facilities Corp (NYS EFC) is now soliciting input from representatives of and organizations within communities that may be affected by projects included on the Annual List of the CWSRF IUP or the Readiness List of the DWSRF IUP. Comments received will be considered by NYS EFC's Smart Growth Advisory Committee.

The final 2012 CWSRF and DWSRF IUPs can be obtained from NYS EFC's website at: www.efc.ny.gov.

Written comments will be accepted until the close of business on Thursday, December 22, 2011.
