Project Description:

The applicant requests to renew and transfer an existing permit to install instream structures for whitewater recreation improvement with proposed modifications to include four sites along the Lower Sacandaga River: Stewarts Bridge, Whitewater Park, Middle Wave, and Bow Bridge. Three wave features will be constructed across the width of the river. The wave features will have grouted boulders with a deep energy dissipation pool downstream. The Stewarts Bridge site will have a grade control drop structure with adjustable inverts, sheetpile cutoff wall, and rock wave sill, bisected at its midpoint by an old bridge pier remains, which will become an island. Two downstream bank jetties will be installed. A public parking area will be created on the north side, using project spoils. The Whitewater Park site will have access improvements with two current deflectors for calm water put-in to access the middle wave downstream. The Middle Wave will have a midstream rock pod (grouted large boulders) with grouted rock jetties on either side, with upstream sheet pile cutoff wall on the south bank jetty, and large boulder armoring on the center stream bottom between the jetties. The Bow Bridge site involves the placement of a double sill bisected by an island located at the existing rail bridge and will have two low points which form waves and holes. Each low point will have an adjustable precast concrete invert allowing adjustments to the hydraulic form as necessary by the Riverkeeper at times of no/low flow. The structure will be constructed with grouted boulders, sheet pile cutoff wall, and a deep energy dissipation pool downstream. The existing Bow Bridge sill will be removed, rock to be reused in the new structure. Three bank jetty's will be installed, with some localized bank stabilization. Total amount of fill for this project is estimated at: 4,067 CY, 633 CY of that will be reused. Total surface area of wave structures including pools and jetties is 62,767 sq ft, 10,119 sq ft of that will be above high water mark. There are two existing put-ins at Stewart's Bridge and an existing take out at the River Manager's site with an additional south side take out at former Hadley Town Beach. The site is located in a 3-mile stretch of the Sacandaga River along North Shore Rd between Stewarts Bridge Dam and the confluence of the Hudson and Sacandaga Rivers. The project was also reviewed and permitted by Adirondack Park Agency APA #2010-205, Army Corps of Engineers #NAN-2004-01316, and Office of General Services.

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a renewal of the Air Title V Facility permit. The renewal permit also includes requirements for Best Available Retrofit Technology (BART) for control of SO2, NOx from the kiln, and PM from the kiln and clinker cooler. As required under Part 249, each BART determination such as the BART determination discussed in this Notice, will also be submitted to the USEPA for approval as a revision to the SIP. Lehigh is also looking to burn Enviro-Fuelcubes as an alternative fuel to coal. They performed stack testing with this fuel last Fall with no significant increases in emissions of any contaminants. There were minor increases in Dioxin/Furan, chromium, lead and nickel but all results were well within allowable emission limits.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing.
